Ms. Porter, have we come to Executive Session as the county judge believes?

>> yes.

>> this morning, we indicated we would take two items into executive session under the consultation with the attorney.
exceptions.
and they are 22, the matter involving a request to vacate the five-foot widity drainage easements of lot 8 block d of kingsberry park section one in precinct one and 24, filing of an instrument to reject and abandon the public streets lenape trail, lenape cove, superview drive and indian scott trail.
and make those private streets.
and posted for executive session are 37, receive legal briefing and take appropriate action regarding a proposal regarding certain open space land near gilleland creek and precinct 1 and draft development agreement with txa and city of Austin and 38 consider and take appropriate action regarding circuit of the americas and formula one including but not limited to the following the mass gatherings act, b improvements of elrow mcangus and kellam roads proposed public safety plan and item 39 receive briefing from county attorney and take appropriate action regarding procedural steps following employment action concerning mary moran.
we will discuss these matters in executive session and will return to open court before taking any action.

 



we have returned from executive session where we discussed the items that we announced beginning with item number 22, the matter involving a request to authorize a vacation of a drainage easement in order to accommodate a septic system.
we did get our legal issues addressed on the public hearing.
we heard from residents who objected to this.
we had a conversation with staff about what we wish for them to do and based on our request for additional work, I think we suggested, what, two weeks from today?

>> yes, indeed, judge.
a minimum, anyway.

>> two weeks would be June 5th?

>> yes.

>> June 5th.
for that one.
and 24 is the matter involving the conversion of platted private streets to public streets which would impact current nearby neighbors and we requested on that a meeting of the developer and neighborhood residents.
that meeting probably won't take place, until, what, a couple of weeks?
do you want to do three weeks or four?

>> three, at least.

>> [indiscernible]

>> okay.
so June 12th.
three weeks.
is that all right?
yeah, and if we touch base during the agenda setting, works a week from these dates we can easily postpone so instead of two weeks and we want to do three, that will be fine.

>> that will be fine.
thirty-seven is a matter involving the potential purchase of open space land near gilleland creek and a matter involving with city of Austin and also txi.
we did get a briefing from staff and that matter is supposed to be discussed with the city council Thursday of next week, and in my view, no further action today.
any other thoughts?

so two days from today.
we will have it back on the agenda next week maybe for an update.

and that's 5/29, just a brief update because that's supposed to be an abbreviated meeting.
thirty-eight is a matter involving the circuit of the americas and formula one.
we specifically received a briefing on star flight.
that contract is not ready today but will be ready next week and on the expo center parking contract, Commissioner Davis.

>> judge, I think we need to -- I think move to ensure that we have that expo center contract in place with this corridor and we need to maximize our parking capacity we have there at the particular facility and come back to the court with the particular capacity for that particular corridor event and also we need to check, I guess, with the star of Texas rodeo and folks to see if -- what they have used, for an example, as far as using the grassy area out there at the expo center, but we need to really maximize that, I think, as much as possible, to ensure that we get the maximum capacity for that particular event.

>> okay.
and we have a contract on this one.
that's been signed by circuit of the americas representatives.

>> yes, and we need to move forward, I think, with that contract, but with those particular caveats in mind, to make sure that we get the maximum potential out there at the expo center.

>> okay.
so approve the contract and gather the information that we discussed.

>> yes.

>> and that's seconded by Commissioner Gomez.

for those who have been watching this item, we do have a public hearing scheduled on June 6 and we have indicated previously that back-up would be available for distribution to the public Friday of this week, and that is may 25th, so we do plan to meet that target.
we did discuss other aspects of this item, but in my view, no further action necessary today.
we have been carrying this from week to week and we will continue to do so.

>> is that -- what week is that?

>> it is a Tuesday, two weeks from today.

>> right in this courtroom at 9:00 a.m.

>> at my age, every now and then you do miss a date.
that's the only explanation I can give.

thirty-nine, we did discuss with legal and legal will take some procedural steps and either report back to us next Tuesday or Tuesday, two weeks from today.

>> so either the 29 of may or the fifth of June, and hopefully we will know that by Thursday of this week and if it's not ready we won't put it on.
if it is, we will have it on.
