We have returned from executive session where we discussed the items that we announced.
Commissioner Eckhardt had to run to another commitment and will miss the rest of the meeting.
item number 26 is a matter involving the payment for starflight services rendered to henry estrada.
in view of the total circumstances I move that we accept $664 in payment of this invoice.

>> I second that, judge.

>> seconded by Commissioner Davis.
discussion?
all in favor?
that passes by unanimous vote.
item 27 we discussed previously, and I'm not sure what Commissioner Eckhardt had in mind, so let's postpone this item until next week and bring it back for follow-up discussion and hopefully action.
28 the same thing.
I don't know if Commissioner Eckhardts wants to touch base with the other side and have it back next week.
29 is a matter involving the possible lawsuit against amber kalin to recover damages to a owned guardrail.
I move the county attorney file an appropriate lawsuit in this matter.

>> second.

>> discussion?
all in favor?
that passes by unanimous vote.
30 is a matter involving the 1501 blue bluff road, Austin, Texas.
I move that we authorize the county attorney's office to file an action for appropriate injunctive relief and civil penalties.
seconded by Commissioner Davis.
discussion?
all in favor?
that passes by unanimous vote.
31 is the matter involving the jesse bowels road improvement project in precinct number 1.
I move that we approve a resolution to file a condemnation petition or two petitions, one involving parcel 1, the vorwerk tract, and another involving parcel 2, which involves the bitner tract.

>> and that would be in the form of a resolution, correct?
for the condemnation?

>> yes, sir.

discussion?
all in favor?

and item number 32, specifically 32-b regarding kel lamb road, I move that we approve the proposed real estate contract and we authorize the county judge to sign on behalf of the Commissioners' court.

>> second.

>> discussion?

>> yes.
consistent with my vote on this last week I will not be voting in favor of this.
it is no reflection on my opinion on other f1 related items. I just don't believe that we should be spending taxpayer money on these roads for a private entity.

>> all in favor?
show Commissioners Davis and yours truly voting in favor.
Commissioner Huber voting against.

>> it's late.

>> it's late in the day.
33 is the matter involving the request for a formal hearing by mary e.
moran.
we did discuss it with staff and gave directions and I suggest that we have this back on the court's agenda next Tuesday for appropriate follow-up action regarding options that will be laid out for us.
with that I believe that does it for our work today.
move adjournment.

>> second.

>> all in favor?
