on behalf of item, we did indicate that we would take it into executive session for consultation with attorney, and that's 29, item, consider and take appropriate action on economic development agreement with apple, inc.
we will go under consultation with attorney and the economic development negotiations and before I forget it, let's just announce that a1, receive briefing from the county attorney and take appropriate action concerning submission by Travis County about emecuscuria brief of gn-01-00894, sierra club and llc, consultation with attorney, with the exception of the open meetings act and those that are posted for the agenda for executive session, beginning with 31, consider and take appropriate action beginning with payment offered to star flight services to henry estrada, have been asked to pull number 32, again, pull 32.
it won't be announced or discussed.
thirty-three consider and take appropriate action from an offer from the city of Austin, Austin energy to purchase 7.46-acre electric line easement on land within the northeast metro park in precinct 2, for installation and operation of Austin energy overhead high transmission line across the park.

thirty-eight, receive briefing from the county attorney and take appropriate action regarding illegal subdivision at 6413 forest hills drive, Austin, Texas, 78746 and resulting violations of chapter 48 regulating on-site sewage systems, consultation with attorney exception and 39, consider and take appropriate action regarding circuit of the americas and formula one, including but not limited to the following: a, the mass gatherings act, b improves to elroy, mcangus and kellam roads, c, proposed public safety plan, d, proposed traffic management plan and e, other related issues.
we will discuss these items in executive session but return to open court before taking any action.



We have returned from executive session where we discussed the items that we announced.
Commissioner Huber had to run to another commitment.
and so -- so we will have to finish the meeting without her.
we discussed number 29 the matter involving apple, inc., economic development proposed agreement.
in view of the public hearing that we had this morning and our executive session discussion this afternoon, I move that we ask staff to work further on the proposed agreement to address any inconsistent points, some of the items that were raised during the public hearing, that if possible that work be done today or first thing tomorrow morning.
with the apple representatives.
and any other I guess interested persons in the courtroom now.

what we did with staff was to cover some of the specific things that we wanted addresses.
if others surface, that -- that we need clarification on, then I think staff and apple reps should feel comfortable doing that.
this will be back on the court's agenda next week for further consideration and hopefully action.
and the best we can commit to is bringing it up -- as early as possible, maybe 10 or so and trying to take action on it.
is that all of that discussion friendly to the motion seconder.

33, a matter involving a request for an easement across northeast metro park but Austin energy, Commissioner Eckhardt?

>> I would like to take one more week to take a look at a couple of things before we make a counteroffer to the city.

34 we discussed the matter involving potential purchase of 172.381 acres of land.
we decided to take no action on that, too, right?

35 the matter involving potential purchase of a small piece of land that we need for the onion creek open space parkland.
second Commissioner Gomez's motion to approve payment of $3,000.

number 36 the matter involving guardrail, we didn't discuss that item, postponed until next week.

37 is the possible acquisition of conservation easement.
Commissioner Davis, I think on that one we asked staff to contact -- powers that be at the state.

>> yeah, let me just make a motion to the fact that I would like the staff to draft a letter and to the -- to the nrcs, natural resource conservation services, to let them know that we have interest in this particular conservation easement within precinct 1.
and that you, judge, be authorized to sign this letter and this item be placed back on the agenda next week for consideration.

38 is the matter involving a -- an alleged illegal division and possible violations of the regulation on -- on site sewage systems. We did get briefed by staff.
at which we requested no action from the court today and they will let us know when to put it back on the court's agenda.
39 is the matter involving the circuit of the americas and formula one project.
I move that we schedule a public hearing on the mass gathering act one month from today.
if I'm right on that, that will be the 1st, 8th, 15th, 22nd.

>> the 22nd is a Tuesday.

>> okay.
we schedule that for the 22nd of may.
and that we indicate to americas, to circuit of the americas that we need backup for that item two weeks from the date of the hearing so we can make information available to the public and interested residents.

any discussion on that motion?

>> yes, sir, would that backup made available to the residents include both the real estate agreement with regard to -- kellam as well as the road agreement with regard to elroy road?

>> all available -- all available backup.

>> including price tags, associated with those two agreements.

>> if that's available, yes.
so my goal is to make public all public information.
the other thing is that two weeks before that public hearing, we should have it back on court's agenda for any and all legal advice and consideration of any and all appropriate action.
so to give us an opportunity to make a sort of cleansing consideration and action if necessary.

also, the final item, a 1, the request for authority to submit an amicus curiae brief on behalf of Travis County in the lawsuit of sierra club versus Texas commission on environmental quality and waste control specialist, llc, I move that we authorize the county attorney to file such brief.
