Executive Session
We're to executive session now.
we have three items for executive session discussion.
32, receive briefing from the county attorney regarding violation of the Travis County fire coat at 1210 Moore road and take appropriate action.
consultation with attorney exception.
33, consider and take appropriate action regarding letter of resignation from rodney rhoades, county executive of planning and budget functional area and issues related theretoo.
the personnel matters exception.
and a 1, consider and take appropriate action on potential acquisition of open space land in precinct 3 and this will be executive session under the consultation with attorney and real property exceptions to the open meetings act.
we'll discuss these three cases but return to open court prior to taking any action.

32, the matter regarding violations of the Travis County fire code at 12101 Moore road in Austin, Texas.
I move that we approve the resolution authorizing the Travis County attorney to file a lawsuit regarding -- to enforce compliance with the Travis County code to seek injunctive relief and prevent violations and threaten violations of the fire code, to pursue any other appropriate and proper relief for Travis County against the owners and/or representatives of this establishment.

>> and that any other appropriate action -- deemed appropriate by the county attorney's office be taken on behalf of Travis County.
second by Commissioner Gomez.

33 is the matter regarding the resignation by rodney rhodes, county executive of planning and budget and issues related thereto, including interim measures to manage the transition.
I move that we appoint leroy nales, the assistant director to fill the position that Commissioner Gomez and I served on the subcommittee on the Commissioners court to meet with mr. Nalles to discuss salary, other duties and assignments, that mr. Rhodes has covered previously and any other matters involving staff and the planning and budget office, that we try to arrange that conference between now and 5:00 Friday this week, have an appropriate item on the court's agenda next Tuesday.
and then we post any other matters regarding this transition that the court needs to consider and act on.

and we'll be able to clarify any questions and if we can't clarify them we'll put them on the court's agenda next week for clarification, okay?
we will probably want to chat with you next week and we promised to meet in executive session long before we convened in executive session today, but I have to warn you that we advised the previous director of the same thing.

and the final item that we discussed in executive session, the matter involving the acquisition of open space land in precinct 3.
we did discuss that and various options with the appropriate county staff, and I view no action necessary today.
