Now let's call back to order the voting session of the Commissioners court.
why don't we call up item number 34, an open court discussion appropriate.
then hold off on the item until we go into executive session to discuss it under the consult tages with attorney and real property exceptions to the open meeting act.
34 is to consider and take appropriate action regarding various provisions in the contracts Travis County has with the star of tex as rodeo and g and m catering.
we have representatives here from the star of Texas rodeo.
this involves a request made to our concession heir, g and m catering.

>> good afternoon, judge Biscoe, Commissioners.
i'm bucky lam, ceo of the star of tex fair and rodeo.
i have with me here in the audit audience our president, our president' elect and secretary treasurer freb weber.
i come before you today to ask for your approval to allow gmc catering to modify their liker license boundaries for the 2010 fair and rodeo.
as you know, the star of Texas fair and road joe a charity.
our mission is to raise funds to support collect scop--scholarships.
to date we have awarded more than $4 million to the youth of this great state from all walks of lifement for many years our organization has hosted a barbecue cookoff and bullet prove private party to generate scholarship dollars.
these events are vital to our fundraising efforts.
in 2009 our leaders met with the Texas alcoholic beverage commission and gmc catering and da bc advised us to have gmc modify their liquor license boundaries where by the barbecue cookoff and bulletproof private party wither to be drawn outside of the licensed area.
the modifications legally allows a star of Texas to accept donated products for our fundraisers.
gmc submitted their application with modified boundaries and tabc approved the application.
the 2009 fair and rodeo operated successfully in this manner.
recently, and just days before the 2010 fair and rodeo, gmc catering informed us that Travis County approval is required to again modify the liquor license for our 2010 events.
so as a result, I come before you today to ask for your support.
the star of Texas fair and rodeo requests that the court approve gmc catering's request to modify the liquor license boundaries for the 2010 star of Texas fair and rodeo.

you are asking for what was done last year.
>> yes, sir, that is correct.
>> has the catering responded?
gm catering?
what is their position?
>> their position is that last year there was no request, and they further investigated that it could compromise their contract between the county.
so because it was done, we were busy with the rodeo last year and they were busy with the rodeo, we never all got together on the same page because it all happened in the 12th hour.
consequently they looked at matters and asked the county attorneys, is there something that we need to get approval for.
they are being more prudent this time and saying we would rather ask for permission than forgiveness.
>> so even if we approve it, ta about.
c still --tabc there's grant the boundary modification.
>> yes, sir, and I have a letter from the president of gmc catering making the request, as well as an e-mail correspondence from carolyn beck, director of Texas alcoholic beverage commission, stating that they would approve such a request.
and I would be glad to provide those.
just received these today.
>> okay.
you have a copy of those?
>> what about the gmc contract?
>> okay.
>> what we will do, we have one other item or two to take up in open court.
then we will convene in executive session.
there's a long list of executive session items.
i always miss my projection, but I project we will be in an hour and a half at least.
>> okay.
>> I put at least there.
i wouldn't be surprised if it took longer than that because we have probably 12 items.
three or four of which are pretty meat agree.
