it's intended to reduce the size -- 24 is to consider and take appropriate action on an offer from the city of Austin, Austin energy, to purchase an approximately 7.46-acre electric line easement on land within the northeast metro park in precinct two, for installation and operation of an Austin energy overhead high-transmission line across the park.
that's under the consultation with attorney and real property recommendations to the open meetings act.
25, consider and take appropriate action on the acquisition of approximately 172.381 acres of land in northwest Travis County in connection with the balcones canyon lands conservation plan.
real property exception to the open meetings act.
26, receive briefing from county attorney and take appropriate action on request from mary e.moran for a formal hearing before the Commissioners' court on recent termination from Travis County.
that's the consultation with attorney exception.
and 27, consider and take appropriate action regarding circuit of the americas and formula one, including but not limited to following: a, the mass gatherings act sb, improvements to elroy, mcangus and kellam road; c, proposed public safety plan; d, proposed traffic management plan.
and e, other related issues.

we will discuss these items in executive session, but will return to open court before taking any action.

 



we have returned from executive session.
we did get to discuss all of the executive session items except two.
the one involving circuit of the americas we started on, did not finish.
we'll complete that this afternoon.
and also we'll need to call up item 26 this afternoon.
we have a special program for long-time county employees at 1:30 that in my estimate will take about an hour.
so I think we're looking at the rest of the agenda except for that ceremony for employees to start at 2:30.

this morning we started discussing our executive session items and did not coomplete item 27: consider and take appropriate action regarding circuit of the americas and formula one, including but not limited to the following: the mass gatherings act; improvements to elroy, mcangus and kellam roads; proposed public safety plan; proposed traffic management plan; and other related issues.
this item is posted under the consultation with attorney exception.
the other item we did not get to is item 26, receive briefing from county attorney and take appropriate action on request from mary e.
moran for a formal hearing before the Commissioners court on recent termination from Travis County.
consultation with attorney exception, also.
so we will only announce these two items because they are the only two that we need to discuss.
we will have our discussion in executive session but we will return to open court before taking any action.

item 24, the matter involving the request from the city of Austin to purchase approximately 7.46 acres of electric line easement through the northeast metro park.

>> I move that we counter the city of Austin's offer to purchase with our own offer to sell the property, the easement, for $450 million, contingent --

$450,000 contingent upon approval of the sale by our grand tour parks and wildlife and chapter 26 hearings held by or jointly with city of Austin and Travis County.

number 25, the matter involving the acquisition of approximately 172.381 acres of land in northwest Travis County for the bccp.

>> I move that we accept the offer of nine million dollars to sell the property.

and there are a couple of other provisions of note contained in the proposed contract.

>> I believe that they're standard.
do we need to enumerate them?

>> I'm just saying they're in the contract.

>> they're in the contract presented to y'all.

>> so part of this is to accept the offer to sell and approve the proposed contract.

I request that we delay action until week.
we did ask ms. Thomas to get additional information, so hopefully we can consider that information and take action on this item next Tuesday, which would be the 15th day of may.
27, the matter involving the circuit of americas and the formula one.
I move that we postpone the hearing that we had scheduled for -- or planned to schedule for may 22nd and have that hearing on June fifth instead.

it's a draft.
we've already identified some improvements that need to be made.

and it needs some work.
but they are working directly with our staff to make those changes.

>> will we get a final application or will there just be amendments to this application that they have supplied?

>> do you want to respond to that?

>> as we -- Commissioner, as we worked through the documents, the application will become final as we get to the hearing.

>> at what point will it become final?

>> as soon as possible.
I'll get back with you on an answer.

>> because it appears to me we should have a final application even if it does need amendments to it.

>> right.

>> at a point in time significantly in advance of June fifth.

>> I hear you.
yes, ma'am.

>> we have said we hope to have backup ready for distribution to requesting parties, approximately 10 days before the hearing.
so if we follow that, what's that, about may 25th?

>> yes, sir.

>> may 26th, something.

>> somewhere in there.
backing up 10 days from June five.

>> that would be good and we do expect to receive requests for copies of whatever has been filed.

>> and that's the other issue, judge.
coda did advise us in a letter to me this morning that some of the information in that application they believe is security sensitive.
and I'll be glad to share the letter that I received giving coda's explanation for why they feel it is that way.
so some of it may need to be reviewed for release through the county attorney's office.

if we get requests then we'll just follow the law on that.

>> release what is clearly not covered and what's questioned, basically follow the law.

we've been having it on the agenda every week.
we'll leave it on in case we need it.
the language is pretty broad and inclusive.
if we need a language change, steve and tom, just let us know, otherwise we'll repeat this language, okay?
