Item number 1 is a public hearing to receive comments regarding a request to authorize the filing of an instrument to reject the dedication of public streets, sandia loop, loasa cove, point o'woods, and caribou trail, all originally dedicated to the plat of the foot hills of Barton Creek, a subdivision in precinct 3.

the streets in this subdivision were part of a plat that was done in 1984 and then there was an order authorizing -- as part of the order authorizing the filing of the plat the foot hills of Barton Creek.
back in October of '93, these streets were included in a declaration for the homeowners association stating that they would maintain the streets and then in '97 these streets were formally deeded to the homeowners association.
there are -- some of these are gated and the applicant requests that they be abandoned from our system so that they can become private streets.
I've heard from the utility companies in the area and they don't have an issue, however -- and I know of no objections to this, but there is one remaining housekeeping issue regarding a utility easement to Travis County number 4 and until what easement is recorded we would ask that the court not take final action and approve this.
but like I said, I know of no objections.
this meets our requirement and we will recommend approval.

>> so if we reject the proposed dedication, the effect of that is what?

>> they will become private streets.
we have never maintained these streets for maintenance.
we never accepted them into our maintained street system.
so rejecting them would make them eligible tore private streets.
there is already a declaration speaking to the private maintenance and liability of these streets and we know of no objections and we don't object.

just to let you know we found out in the last couple of weeks that our easements for all of our utilities dead ends into caribou trails.
so once these streets are vacated, our easement dead ends.
so we are working with the applicant to get a permanent easement down caribou trail and out of the subdivision recorded in the next couple of weeks so that we don't have a problem.
we didn't want to interrupt your public hearing today, but we didn't want final action until we could resolve that.
so thank you for your time.

we would request a postponement on that.

>> what is the effect of us delaying action on that?

>> it just would delay when this would be a private street.
I'm fine with that and what I would recommend is as soon as we get a copy of that recorded easement we will put it back on the agenda, just the action part.

>> your discussions will take two to three weeks?

>> I think we can get this done in the next two weeks.
we realize that we need to get this done.
we just were not aware of this until the last ten days to two weeks and then we didn't know this public hearing was until last Friday or Thursday we found out, so we're behind it now and trying to get it done.

>> any objection to postponing action on 13?
that was a motion to close the public hearing by Commissioner Huber, seconded by yours truly.
