4, receive comments regarding a request to authorize the filing of an instrument to vacate a ten foot wide section of a 25' wide drainage easement located along the east lot line of lot 5, block h, of long canyon ii-a, a subdivision in precinct 3.
by the way this should be precinct 2 instead of precinct 3 it should be precinct 2.
move that the public hearing be opened.

that passes by unanimous vote with Commissioners Huber and Davis off the dais.

>> the purpose of this is also, we also have a 25-foot wide drainage easement located along the east line of the lot.
and the request is to vacate a 10-foot wide section of that easement because they have installed a -- an 18-inch storm sewer pipe to convey the runoff.
this one was a little bit interesting.
we had a public hearing on this back in 2007 and at that time the neighborhood association had some concerns and we met with them, but then, you know, we didn't really hear, hey, we've reached resolution or whatnot until recently.
recently we've been contacted by both sides of the equation, saying, you know, we've reached resolution, we're ready to move on.
so we put this back on the agenda to just finalize whatever.
and so I don't know of any objections.
the gentleman was correct, we did manage to get our backup for the two items posted backwards.
but I know of no objections to this.
so we would recommend approval.
