Number 18, consider and take appropriate action on request from the Travis County sheriff's office association and the combined law enforcement association of Texas for a reduced rental fee to use the Travis County luedecke arena for a fundraiser benefiting the fallen Texas peace offers memorial.
how are y'all doing?

>> good morning, judge, Commissioner, roger el khoury.

>> [indiscernible] to book the luedecke arena on may 5th, 2012, for fundraising benefiting the memorial for the fallen Texas peace officers.
and we have the facilities available on may 5th and they are requesting to waive all the fees for the event.
the event is one day.
and because of the you a o.
-- the rental of 25 tables and chairs is about 450.
utility costs for operating for eight hours a day is about $1,000.
and also the cleaning

>> [indiscernible] also about $600.
facility management recommends the -- to waive the fees for the facility rental only, you know, which is about 3,450 including the rental of the equipment which is the chairs and the table.
and facilities management does not recommend waiving the direct cost which is cost of utility and the

both of these are going to come out of

>> [indiscernible].

>> if we grant the request, it would be to waive the facility rental fee of 3,000 and the equipment rental fee of $450.
but the other charges or costs we would collect.

>> that's our recommendation, judge.

>> anybody here from the requesting offices?

>> what day of the week is may 5?
it's a Saturday?

>> which includes the barbecue kickoff.

>> and what hours, do you remember?
the hours?

>> it's on may 5th all day.

>> all day.

>> now, two issues were brought to my attention that I promise to do bring up.
one is whether we -- whether I would ask the requesting parties would be asked what steps will be taken to ensure that funds raised will be spent on the memorial?

>> okay.

>> so rather -- if there is nobody here, then instead of asking that question, I would basically ask the court to make that a condition upon which we approve the request.

>> okay.

>> the second one is whether the fund that are generated will be used in strict compliance with government code section 3-105 and I was sent a copy and it specifically says that the funds are to be used for the memorial.
they are supposed to be sent to the commission to be deposited in the capital fund account and there are really specific things you are supposed to follow.
so if they are not doing this, they are not following the law and with certainly don't want to be part of that.
so rather than asking questions of people who are not here, my recommendation to us would be on these two points we make clear that we are approving the request contingent upon compliance of that act and making sure the fund raised will be spent on the memorial.
now, to be honest if people collecting these funds are handing themselves to somebody else, so I think our view should be we don't care who does it, but wherever the money ends up ultimately it will be spent in a matter consistent with the law.

>> are you including in the motion our recommendation to waive everything except direct costs?

>> yes, sir.
we collect all the other costs we normally collect.

>> this is one of those areas where if you collect the money, if you really are not careful about where it goes and whether you track it, you can lose sight and bad things can hatch.
but this is a lofty purpose.
and if these funds are spent in the manner prescribed, then it seems to me we ought to assist with what we're trying to do.
