number 34, receive briefing from county attorney and take appropriate action concerning the extension of administrative leave with pay for juvenile probation employee in slot number 360.

35, receive briefing from county attorney and take appropriate action to file an amicus curiae brief with the supreme court of Texas supporting the city of Austin's petition for review in harper park two, l.p., versus, city of Austin.

all four of these individuals have been invited down.

29 is the matter involving the clean air force and a proposed interlocal agreement between the clean air force and Travis County, and this will be under consultation with attorney exceptions also.
we'll discuss these -- yes, ma'am.

We are back from executive session, where we spent a few hours, but in addition to regular agenda items, we did conduct four interviews to fill the vacancy in the tax assessor collectors office.
we discussed the -- the -- all of the items that we announced.
including number 34, the matter involving extension of administrative leave with pay for juvenile probation employee, slot number 360.
I move that we approve an additional seven days.

35 the matter involving a request from the city of Austin to file an amicus curiae brief with the supreme court of Texas supporting the city of Austin's petition for review in harper park two, lp v.
city of Austin.
move that we approve the filing of such a brief.

the matter that has been pending in the san antonio district court and has made its way to the u.s.
supreme court.
I move that we authorize an additional $30,000 for legal fees and that the money be taken from allocated reserve.

39, the matter involving the lawsuit against john ford in Travis County by the estate of rachel jackson and other related individuals, we got an update.
in my view, no action today.

40, the matter involving the request from Austin suites management written demand letter, I would call it.
I move that we authorize the county attorney to send an appropriate response and that we have the matter back on the agenda again at the appropriate time.

we did conduct four interviews posted in item 41.
there was a person that we did not discuss today, I move that -- that we did not interview today.
I move that we authorize the county judge to contact that person, let her know the result of the court's discussion.
further, that we ask the county attorney to give us a legal opinion on two or three issues involving one of these applicants.
and be prepared to meet with us in executive session next week and indicated to the persons that we interviewed our intention to take action on that selection next Tuesday, which is a matter of importance to them.

the other item we discussed was the matter involving the request for an interlocal agreement with clean air force.
we did get the briefing.

>> well -- if you are requesting a week, we'll take a week, if that's what you are requesting.

>> the reason why I asked there was an email that the executive director apparently didn't know the item was on the agenda.

>> we're going to approve it.
I don't know that we ought to postpone it.

>> I would like to hear from her --

>> but I think what we ought to do is sometime within the next few months get staff to get with them, look at the deliverables as contained in the backup that we were provided, figure out a way to ensure that those -- the deliverables for 2012, one and two that we make some effort to -- to document efforts to achieve those and the success or failure, so that we get an annual report before we act on this in 2013.

>> so this is just the motion is to move forward with negotiating a contract for 2013 to come back to us for approval.

>> that's going to be my motion.

>> it would be a 2012 contract.

let me make a motion.
I move that we go ahead and approve the 10,000 request from the clean air force, the source of funding, hopefully will come from the allocated reserve and also that we have staff to monitor the deliverables that will be offered from the clean air force to Travis County within this particular time frame of one year.
and of course -- of course again, we want to -- we want staff to be on top of this to monitor and look at the deliverables that -- that the clean air force will be bringing forth to Travis County.

>> and could I ask an amendment to the motion as I did earlier for approval to be done as an automatic budget adjustment.

>> but we expect the contract, though, right -- some contact though, right.
the action is to transfer the money into t.n.r.'s budget, indicate our approval of 10,000 bucks for these deliverables, scrub the deliverables, put them under contract, plan to monitor during 2012.

>> exactly.

>> what I would add to that is at some point I think that we need to touch base with capcog, campo, other agencies that do work in the same area, so if there's a duplication, we'll know.
two is that if we find it, we can try to eliminate it.
and to make sure there's the appropriate cooperation, collaboration, for us to receive the most bang for the dollar.
so I -- this time next year, we ought to have a better feel for these -- for the truth of various things that we've heard.

of course we -- by this we'll be able to move forward with it to do just some of those -- in the suggestions that you just made.

>> I would ask, there's no t.n.r.
people here, but to make the record, as we move forward, one of the -- one of the points that the document that was sent to us by clean air force made about their achievements is a -- is a -- a commuter van service that never came to fruition.
so I would like to see that further explored and possibly with our -- our datma

>> I think it would help us to have like a full discussion after the first of the year.
so -- so anything we want to initiate, immediately, for further review by us later in the fiscal year or before the next budget cycle would have an opportunity to do it.
I would rather us take our time to do that if we're going to do it.
I think it would be more fair to them, also.

so we'll just wait for the contract to come back.
