Executive Session

So if we take 6 this afternoon, we're looking at executive session.
my recommendation would be we go into executive session, get as much done as possible and come back this afternoon and take the broadest item.
34, consider and take appropriate action on an offer from city of Austin to purchase an approximately 7.46-acre electric line for installation and operation of an Austin energy overhead atlantis mission line high across the park.
consultation with attorney and real property exceptions to the open meetings act.
this morning we announced postponement of 35, 36.
37, consider and take appropriate action on acquisition of open space land in precinct 3.
consultation with attorney, real property exceptions.
39, receive legal briefing and take appropriate action regarding Travis County involvement in legal action objecting to congressional redistricting by the Texas legislature.
consultation with attorney exception.
40, receive briefing from county attorney and take appropriate action in eddie hall versus quincy lamont styles.
consultation with attorney.
and 41, conduct performance evaluation for deece eckstein and take appropriate action and that's the personnel matters exception to the open meetings act.
we'll discuss these items in executive session but will return to open court before taking any action.

we will not announce the items that we announced this morning but did not discuss.
there were a couple that we didn't get to.
however, item 40, receive briefing and take action in eddie halls versus quincy styles.

41, conduct performance evaluation for deece eckstein and take appropriate action.
personnel matters exception.

see that document after court and if it looks all right, sign it, if it doesn't, have it on the agenda next week.
look all right means basically consistent with what we've discussed.
special significant stuff.
minor stuff probably won't matter.
so do I need to announce it?
it's going to be hard to read in executive session anyway.
I think what tom wants us to do is go ahead and authorize me to sign it so they can go ahead and prepare for closing and not be an issue anymore.
I was just going to make that one come back.
just those two items.

by the way, Commissioner Eckhardt had to run to another commitment a few minutes ago.
39 is the matter involving -- let's hold off on that one.
40 was a briefing that we received after a lawsuit was taken to trial in the matter of eddie hall versus quincy lamont stiles.
the only thing we need to do is congratulate the county attorney's office and thank him for doing an outstanding job for us on that matter.
otherwise no action.
41 we did evaluate deece eckstein and in my view no appropriate action is necessary today.
any view to the contrary is this.

>> now, on the matter involving 39, the congressional redistricting, in my view what we need to do on this item -- have we received anything yet?

>> may be recess till 10:00 tomorrow morning.

>> and if we know by 5:00 today that month map has been received we still need to come down to 10:00, call to order and adjourn it basically.
but that will give us an opportunity at least to appear.
and if we've got three, I don't know -- we're in a difficult position because we don't know what the map making time even if we have one.

tomorrow morning and the one item that we would take up at that time would be item 39.
and contingent upon our map receiving a map from the san antonio district court and the congressional redistricting lawsuit that the county has been part of.

we thought we might receive a map from the federal district court in san antonio, but as of 10:06 today we have not received a map, therefore there is nothing for us to consider and no work to be done today.
mr. Eckstein, are you prepared to comment?

>> not really, judge.

I would just affirm what you just said, we do not have maps yet.
