we were waiting for response for the low bidder or apparent low bidder which was nonresponsive so that's why we are going to the second responsive low.
we sent a certified letter to him informing him that his bid would be rejected as nonresponsive buzz he didn't submit a bid bond.
we didn't hear back from him until yesterday.
I planned to push it one week but once we got the information back, I said let's see if we can get the information to the court, and as I said, I apologize for late arrival but we wanted to get it on.

one of the requirements we go through bid sync as the court is aware, electronic third party bidder for disseminating our bids and one of the requirements they can submit electronic bid to us but they have to follow up with a sealed copy, hard copy within 24 hours and the bidder failed to do that and the instructions are clear on those procedures.
