Executive Session

21, consider and take appropriate action regarding claims from and settlement agreement with tecolote farms. 22, we discuss this morning and that's the matter involving termination of the county water outlet in southeast Travis County.
we have legal questions there.
that will be consultation with attorney.
going back to item number 2, this morning we indicated we had a list of legal questions.
and two, remember, is the item involving damage caused by recent wildfires and injuries suffered by Travis County residents, including remaining fire issues, cleanup in Travis County, collaboration with fema.
and mr. Manila provided a good memo that contained several of those legal issues that we have.
and we have posted for executive session discussion -- by the way, number two will be consultation with attorney too.
31, consider and take appropriate action on the sale of approximately 3.19 acres of land in precinct three.
and that will be real property.
and let's also announce consultation with attorney exception.
just in case we need it.
so those are four items that we need to discuss in executive session.
we will discuss them there, but return to open court before taking any action.

31 is a matter involving the potential sale of approximately 3.19 acres of land in precinct 3.

>> move that we accept the offer of $285,000 for the sale of this to the buyer, the proceeds of which go back to the preserve fund.

22, the matter involving the termination of county water outlet in southeast Travis County.
we did announce this morning that we would not take further action on this item until at least two weeks from today.
and that is the 25th of October.
and in my view at that time we ought to have a list of specific actions to act on.
between now and then we should touch base with the creedmore water supply company.
I forget the name of that concern.
Commissioner Gomez, should you contact them?

let's touch base with them and find out what the situation is there and try to help.
and we also will try to get staff to take a closer look at that outlet and see if there are any sort of security, safety concerns that we should try to address between now and then and be prepared to take specific actions next -- on the 25th.
and as our lawyers would say, any other appropriate actions related there to.
anything else on that?

21, the matter involving tecolote farms, inc.
we did ask chris gilmore to make copies of the draft settlement agreement from about two years ago available to members of the court for review.
and we would have that item back on the court's agenda either next week or two weeks from next week.
let me huddle with the court members about their schedule before we decide that.
anything else on that item?
item number 2 is the matter involving the damages caused by recent wildfires and different parts of Travis County, steiner ranch, Pflugerville and spice woods area.
and we did discuss various legal issues.
one thing that I think we need to take action on today is waiver of those fees and appropriate circumstances, especially where there's no insurance that reimburses residents for the permit fee.
and next week we will have a specific plan of action regarding the cleanup of debris, hazardous waste, and other waste resulting from the wildfires.
so the motion is basically a waiver of the permit fee in appropriate circumstances, meaning no reimbursement by insurance.
is there a second?

we talked about several other steps to be taken.
waiver of printing costs where appropriate once we determine the quantity necessary for the public education program.
on the others I think what we need is really an action plan that we respond to, one that's in writing.
so next week we can probably be able to move on part of those, if not all of them, and certainly the week after that.
