Executive Session

Now let's call back to order the voting session of the Travis County Commissioners court.
and I think we covered all our open court items, didn't we, and are ready for executive session.
number 25, receive briefing from Travis County security security matters in relation to fiscal year 2012 budget requests.
security exception to the open meetings act.
26 will be postponed and not discussed.
27, receive briefing from retained outside counsel and take action in alicia perez versus Travis County, number 1:11-cv-00019-ly, consultation with attorney exception.
and a 1, receive briefing from county attorney and take appropriate action on tceq's granting of a contested case hearing with a concurrent referral to alternative dispute resolution in the matter of the application of synagro of Texas for a Texas pollutant discharge elimination system permit.
that item will be under the consultation with attorney exception to the open meetings act also.
we will discuss these three cases, three items in executive session, but will return to open court before taking any action.

number 25, the matter involving the recommendations from the Travis County security committee.
in my view no action required today.
we'll ask pbo to leave the amount that it has in the preliminary budget there for our further consideration during the budget process.
any opinions to the contrary?

we discussed 27, the matter involving alicia perez versus Travis County.
I move that we settle the lawsuit for the amount of $90,000, and that we approve the proposed settlement agreement with the revised language.

>> we don't have to announce the source of funding, but it will be from the risk fund.

>> and also authorize you to sign the necessary paperwork for the release.

>> yes.
authorize the county judge to sign that proposed agreement.

>> right.

>> since it's finalized.

>> I'll second that.

>> seconded by Commissioner Davis.

by the way, Commissioner Eckhardt had to run and handle a critical family matter, so the three of us are here.

Commissioner Davis votes for.
the county judge votes in favor.
those opposed?
Commissioner Gomez votes against.
that carries -- passes by a vote of 2 in favor and 1 against.
a-1 is a matter involving the contested hearing before the tceq.
and the only application of synagro of Texas for a discharge permit.

>> judge, I would move that we authorize staff to agree to resolve the contested case in the alternative dispute resolution consistent with the terms that were discussed.
