consider and take appropriate action on an order concerning outdoor burning in the unincorporated areas of Travis County.
>> good morning, judge, Commissioners, herschel lee, Travis County fire marshal.
the current drought index for Travis County is 634, up from when you enacted this burn ban a week ago.
it did -- the progression did slow down some with the recent light showers, but we have some areas in Travis County that are as high arrest 704.
the current 10-day forecast is for 10 days at 100-degrees or greater with no chance of rain.
we're still seeing a number of small roadside fires.
these are good indicators of just how dry things are.
and -- and Texas across state-wide now is at a record level.
239 of the 254 counties are under burn bans.
my recommendation is for the burn ban to remain in place.
>> so by taking no action, we leave in place the current ban?

>> the current ban will not expire until July 27th.

>> you might -- I would suggest now that you call up item 3 again, which is your outdoor burning ban order.
because the current order recites that it will -- there's only two ways that it can be lifted or expired and that is by the passage of time or by order of the Commissioners court making a determination that it should be lifted.
in light of your action on item no.
4, designating the county fire marshal as another person with authority to lift, I would suggest that you -- that you amend your current burn ban order to reflect that as well.

>> that way if someone challenges mr. Lee's authority two years from now, you will bd able to go to that order and date it July 5th, 2011.
