Now let's call to order the Travis County housing finance corporation.
item number 1, consider and take appropriate action on the following: a, submission of letter to brandt baber, owner of metropolis apartments, regarding the corporation's annual compliance audit.
and b, submission of invoice of invoice of 500 to brandt baber for staff's time.
1 a and b is what's before us now.

>> good afternoon, andrea shields, corporation's manager.
the first item basically is just asking for approval from y'all to send a letter to brandt babier regarding the findings of annual compliance audit.
as you will recall, 20% of the 308 units might be occupied by low-income units, that would be 62 units.
metropolis claimed 122 units as of their compliance report.
on June 15th we completed an on site audit so the requirements of the owner to lease meeting gross income.
and 90% of the units to tenants whose annual income does not exceed 120%.
of the 50 tenant files we audited, we looked for the following items to ensure the income requirements were met to ensure tenants were recertified annually, to ensure proper income very if I indication and the form was signed within 30 days of move-in date.
every file of the 50 files, all 50 were clean.
we confirmed with the director of transitional services at safe place that the property regularly works with them to serve up to five families.
of the 50 files we audited, two were safe place files.
we're just looking for approval to sent a letter to brandt babier and an invoice for $500 for our time.

>> let me get one point clarified.
so in fact safe place the using five units?

>> of the 50 files we looked at we saw two.
the agreement is they will provide up to five units at any given time to safe place depending on the needs of the tenants.

>> so is safe place using five?

>> I believe they are using two at this point in time, but they have the ability to rent up to five units.
but right now there are only two households that are utilizing safe place services that are living at metropolis.

>> it seems to me we need to work with safe place to take advantage of the five units.

>> we can certainly work with them on getting three other households into those units.

>> and my recommendation would be to see how many they use day in and day out, month in and month out, and if in fact they are using two, then we need to try to work the agreement so we can get another similarly servicing nonprofit to take advantage of it.

>> sure.

>> yeah, that -- when we negotiate the deal, it was the five units was pretty important.

>> okay, sure.

>> okay.

>> we can certainly work on that.

>> with that I move approval of a and b.

>> second.

>> discussion on the motion?

We've been asked to take item 2 into executive session.
2, consider and take appropriate action on request from brandt baber with american village communities to reorganize bonds issued for metropolis apartments.
and this will be under the consultation with attorney exception to the open meetings act.
we'll have this discussion with our lawyer with our attorney but will return to open court before taking any action.


>> > we've returned from executive session where we discussed item number 2 under the housing finance corporation.
we did ask legal for response to several questions, some of which will require additional research and so I request that we postpone action on this item until next Tuesday, which is July 5th.
and we commit to consider a hearing, responses to those legal questions and be ready to take action then.
