Item 9, receive briefing, discuss and give staff direction regarding fiscal year 2012 elected officials' salaries as well as the process and schedule for developing any applicable advertisement for a public hearing to set elected officials' salaries for fiscal year 2012.
mr. Nellis, not to steal your thunder, but based on the planning and budget office' review of our financial situation, at this point it looks unlikely that our rank and file employees will receive a salary increase this year, right?

>> that's correct.
and if in fact you were able to find any type of compensation funds, during markup, the recommendation I think from your h.r.
department and from p.b.o.
would be to first address any market salary adjustments, rather than any type of across the board type of increase.

>> in the past, we have given elected officials pay increases at the same time we gave rank and file employees a pay increase.
so at this time, it seems to me that -- that we should indicate that our intention, unless there is a -- unless there is money that we cannot locate at this time available -- that we will not be able to afford pay increases for rank and file employees or elected officials.
what that does is to render unnecessary a lot of public hearing notices, a lot of advertising, which we would have to do if we were to give increases, right?

>> that's correct.

>> but by giving no increases we are not required to have the public hearing or the advertisements.

>> right.

>> judge.

>> any objection or --

>> no.

>> different opinion?
okay.
so our action today would be?

>> it depends on what you wanted to do.
if you wanted to do an order setting elected officials' salaries today you could do that and I could prepare the order between now and the time that y'all finish executive session so you could sign it.
or you could set on date on which you intend to actually set those salaries that is different from today.
either way.
I think --

>> does it affect the time period for

>> [indiscernible] not that I anticipate a need.
grievance.

>> when you set -- when you do the order, setting the -- setting the salaries, is what triggers the grievance process.
if you do it today, obviously you've got more time.
but if you were to do it in July, which was when it was originally on the calendar for p.b.o., then you would still have plenty of time for -- for the grievance process.
so --

>> why don't we just today indicate that in our view, there's not funding available for pay increases for any employee or official at Travis County.
is that in the form of a motion, judge.

>> it is now.

>> second that.

>> yeah.

>> and I guess my point is that -- and it is critical, of course, our rank and file are not getting any salary increases and of course I just -- my opinion it should go all across the board.
but again elected officials are independent and -- but anyway I hope they get the message.

>> we will bring that back in July in case the circumstances have changed and we want to change that decision, we will.

>> beg your pardon?

>> five instead of 12.

>> okay.
I was looking at your backup.
is that yours --

>> that's p.b.o.'s backup.

>> bring it back July 5th, how is that, ms. Rio.
you don't mind us being early with your July 12th date, do you, a week earlier?

>> no, that would be great.

>> for the information and the rest of the court, the reason I am suggesting July 5th I would be able to do the order and be here to review the notice that goes out to the elected officials that day.
I would not be here the following week.

>> any more discussion on the motion?
