>> is there any need to take outdoor burning?
the fireworks item?
>> we will also take item four, yes, sure were.
it is revise language, take appropriate action regarding fireworks and the unincorporated area of Travis County so we will discuss that, five items in executive session, but we will return to open court before taking any action.
we've returned from executive session where we discussed the five items announced.
consisting of item no.
4, the matter involving -- fireworks and the regulation of 'em by county government in unincorporated areas.
I move that we direct staff to put together appropriate data and information in support of a -- local disaster declaration for our consideration next Tuesday.
>> second.
>> and any discussion on the motion?
we'll have this item, also posted for executive session discussion just in case we need it.
okay?
>> all right.
>> all in favor?
that passes by unanimous vote.
item no.
11, the matter involving a modification to the existing contract with broadus & associates for additional consulting services regarding a needs analysis and facilities master plan.
is there a motion?
>> I move extension of the modification of the contract as proposed.
>> second the motion.
discussion on the motion?
>> judge, I would just like to say that I'm opposed to the modification of had contract because I believe as the judges and others have testified here and the district judges have testified here in court, that transparency and fairness in this whole civil courthouse process is important.
I believe it would be inappropriate for us to modify this contract at this time when it would provide for an overlap of services by a firm that may be competing for the current rfs that is out there.
>> any more discussion?
>> I understand that for what I'm understanding this is just basic the modification to complete a -- a downtown campus master plan and it's supposedly the last phase of this particular downtown master plan.
this is the only missing piece in this particular downtown master plan.
so being that since it is the last piece and hopefully this particular master plan will be complete, completed after this particular last phase of the new civil family courthouse, placed within the last phase of this particular master plan is the product that will be owned by Travis County, therefore, I will have to probably support this motion because it is the last phase of an existing contract as far as coming to closure on a master plan property that involves the downtown campus.
>> mr. Rose, any additional comments?
>> no, sir.
>> any more discussion on the motion?
all in favor?
show Commissioners Davis, Eckhardt and yours truly voting in favor.
Commissioner Huber voting against it.
number 24 is the matter involving rachel jackson
>> [sic] deceased against john ford, md and Travis County.
we move that we authorize mediation in this matter.
that our representatives report back to court any proposed settlement negotiations or results and with ask mr. Dan mansour to represent Travis County in the mediation.
>> second.
>> discussion on the motion.
>> judge, I'm not sure that it's clear whatever number is reached at mediation is still subject to approval of the Commissioners court.
>> yes.
the Commissioners court is the ultimate decider.
>> decider, yeah.
>> some of our lawyers every now and then get carried away and think they have the settlement authority.
thanks for reminding us that they do not
>> [laughter] any more discussion or clarification?
all in favor?
that passes by unanimous vote.
25 is the matter involving shay morrow v.
tracy c.
hill, corrections officer.
move that we grant authority to county attorney's office to hire appropriate experts, that this matter be back on the court's agenda next week in the event that we need it.
>> second.
>> discussion?
all in favor?
that passes by unanimous vote.
we also authorize the experts for the source of funding, does the county attorney have a line item for that or allocated reserve?
risk management, thanks very much.
that's the source of funding.
we also discussed item no.
26, the matter involving legal issues associated with the impact on county departments of the circuit of the america's formula 1 grand prix.
any motion on that item?
>> I would move that we provide the city of Austin in advance of their Thursday agenda item, the copy of the letter that went out over county executive hobby and county executive manila's signature to circuit of america's as well as circuit of america's response letter from mr. Steve sexton, along with a brief listing of the county gores of Travis County -- categories of Travis County cost which Travis County expects, as they would of any large event promoter in the past and in the future --
>> second.
>> -- to cover, such as fire, law enforcement, traffic enforcement and any road improvement agreement for costs directly associated with the event.
>> second that again.
>> that's a long motion.
I think that I understood it.
>> all it is is three things.
the existing Travis County letter, the existing circuit of america's letter in response, as well as the brief list that was the genesis of the Travis County letter of Travis County costs likely to be incurred due to the race.
>> and all of those costs Travis County's position is that we would expect to negotiate with the circuit of the america's representatives about an appropriate reimbursement plan.
>> exactly.
>> and action -- I don't know if that needs to be said in the letter, but that's our intention, right?
>> correct.
>> seconded by Commissioner Davis.
>> included, though.
>> any more discussion on the motion?
all in favor?
that passes by unanimous vote.
board members, court members, I hate to tell ya, but we have finished our work today.
>> a 1.
>> a.
>> are you sure?
>> and 12, judge.
>> and 12.
>> [laughter]
>> move approval of 12.
>> I'm glad I didn't -- that's why I regretted telling you that
>> [laughter] a 1 is a -- matter involving the potential purchase of open space land near gilleland creek in precinct 1.
we did get another briefing.
I think it gave some direction to staff about moving on on this, any motion today.
>> no, I think we just need to proceed.
>> okay.
we'll be told when to put it back on court's agenda.
