Number 9, consider and take appropriate action for the following items in precinct 3.
a, revised preliminary plan west cypress.
fiscal is not required.

b, a revised preliminary plan west cypress hills face 3, cypress ranch boulevard.
fiscal is not required for this preliminary plan.
no e.t.j.
c, a final plat for recording west cypress hills, phase 2, section 1, right-of-way only, cypress ranch boulevard.
fiscal has been posted with Travis County.
no e.t.j.
d, a final plat for recording west cypress hills, phase 3, section 1, right-of-way only, cypress ranch boulevard, fiscal has been posted with Travis County, no jet.
e, a final plat for recording west cypress hills, phase 1, section 4, right-of-way only, cypress ranch boulevard, fiscal has been posted with Travis County, no jet.
f, a construction agreement for west cypress hills phase 2, section 1 final plat.
g, a construction agreement for west cypress hills, phase 3, section suttle final plat, and h, a construction agreement for west cypress hills, phase 1, section 4, final plat.
tell me this is simpler than it would apply.

all of this boils down to a portion of cypress ranch boulevard being moved into the phase 3 preliminary plan and then three roadway only final plats.
one is I believe in section -- phase 1, section 4, and one each from the phase 2 preliminary plan and from the phase 3 preliminary plan.
that's really all that it is.

>> can we get with our lawyers and either have a abbreviated item next time or do we enjoy shocking the county judge from time to time.

back in February of 2008, I abstained on this particular item when it came before the Commissioners court, and there were several reasons why I abstained.
number 1, it had to do with a lot of water quality issues in that area.
of course, we didn't want another lick creek type situation.
but I abstained because of a lot of things, but I think -- and anna, I guess you can speak to this on some of the water quality issues that have been addressed where it came up then in February 2008, can you just maybe speak real believe to that point?

>> certainly.
when this plat or this project originally was at Commissioners court prior to 2008, there were some issues.
and by the time 2008 came around, there was, I believe, hank can wrong, a settlement agreement with the neighbors regarding some of the issues.

>> correct.

>> and one of the things that I appreciate about this plat was -- or this relimb was that originally this was one of the ones that got in before the I want room rules.
and as part of the settlement agreement they had with the neighbors, they agreed that the phase 2 and the phase preliminary plan would develop under those interim water quality rules.
and so that took a couple of the projects that we somewhat called buzzer beaters out of that category, and I appreciated that.

okay.
that was just all I wanted to bring that point out.
the reason why I'm going to support this today.

>> judge, I just want to say thank you, Commissioner Davis, for voting as you did when you did.
I wasn't on the court at the time.

>> pardon?

>> I wanted to thank you for voting the way you did on this project because it was problematic from the get go.
but I little want to thank the changes the owner has made and the developer now is doing because sometimes when you get a project off on the wrong foot, it's really challenging to turn it around, and I believe that they are doing the best they can with it and working with us well.
so as I said earlier, I move approval.

>> no.
I appreciate the time and I'm available to answer any questions.

>> now, if you have items on the Commissioners court agenda other than -- other than number 10, which we will call up in just half a second, half a minute, and the other one we need to call this morning is the legislative item, and 24 and 25 for executive session.
and depending on what time we announce executive session, maybe other executive session items. It will be this afternoon when we reach you unfortunately.
this afternoon we will start at 1:30 and there are four or five items that I know we'll need to take up before we complete executive session.
that's how it's looking to me.
it will take probably two hours to cover the three or four items that I just mentioned, 24, 25, 10, and the legislative item.
