Number 12 is to approve order authorizing the Travis County purchasing agent the utilize the alternative project delivery methods for certain projects, that is found in the Texas local government code annotated chapter 271, subchapter h, sections 271.111-271.121, to obtain services for the construction of the new county commissionrs courtroom and offerss at 700 lavaca.

>> thank you, judge, one of the things that dave brought forward was the alternate design construction manager risk that we have not used, I do not believe, before.
we have done a design build.
this is a little bit different.
so part of dave's contract, and actually kind of probono some of it on his part, he is helping us with the documents, contracts.
tinly and I have had a chance to meet with him and go over construction management documents and we need to, she is working on the contracts and we are moving as quick as we can.
one of the things that the law requires is that we come to Commissioners court and ask you and get permission to move forward and utilize this process.
so this order is authorizing us to move forward with the construction manager risk, construction method.
it also is authorizing us to, me the purchasing agent, and hsa and facilities, with the assistance of the county attorney, to get those documents done and get them issued.
in fact, the schedule is us sending out a rfq this Friday, asking for proposals or qualifications from firms to start looking at construction manager risk.
it's a three-step process.
we but in a r fq, we qualify all the firms, a real short documents, and next next piece will be a rfp and we are get into it.
dave is going to hold our hands through the process and make sure that we are doing it as efficiently and as accurately as we can.
tinly is ensuring that we are complying with the law.

>> publicly, if anybody would hear what we are doing here today is something new, we have never done this before.

>> correct.

>> and layout exactly what construction management at risk actually does.
it is an alternative way of design and stuff like that.
but at end of day someone is going ask the question, and this maybe can help them, what actually does this new concept, this new situation that you are dealing with that is coming through purchasing, of course with dave, what does that really mean?

>> okay.
well, very simply, what it does, it enabledrs us to get the construction team on board during the design process.
typically during the design development phase they will work with us, producing cost estimates along with our cost estimates.
at that point, when the design is complete, it will be bidout to the subcontractor community and we will get actually competitive bids for every dollar spent on the construction costs.
during the design phase, when we actually solicit the proposals from the firms, they will be proposing on fee and generally conditions, which are the only two items that they can competitively price at that time because the design isn't complete.
then once the designs is complete, then the rest of the project, the actual cost of the work, will be competitively bid.
so you will be able the answer anybody that a hundred percent of the cost of this was competitively bidand we get the advantage of having them on the team early and build a relationship.
so you don't have the problems on the back end.
I have used this technique for 15 years on almost every project we do.
we just finished the capital dome with that approach, same exact contract.

I don't remember the system that I can remember.
I thought that it was a new twist.
when you have new twist, sometimes have you to explain to the public what you are doing.

>> it is a new twist and we are actually working with tinly to recraft all those documents so you can replicate that process again and again.

>> okay.

>> and the universities have had this authority for probably 15 years.
then counties got it about six years ago.
we used the design build a couple of years ago.
so this is our first at construction manager risk.
