Item 6 is approve contract award for gasoline and diesel to the low bidder, sun coast resources.

I'm going to abstain I guess, but my problem is that -- that I'm having is I'm hearing a lot of concern and protests from community members on -- with using the sun coast fuel situation to use johnny morris road which there have been no through traffic signs placed and yet they continue to come down those roads.
I'm getting a lot of complaints on that particular regard.
so we've tried to get involved with the city of Austin to look at this particular situation, going next to an elementary school with this fuel and all this other kind of stuff.
it's kind of traumatic in the people's minds that live out there.
there's no way in the world I can support continuation of using sun coast if they are going to continue to violate a situation that has been brought to my attention on these no true truck traffic considerations so I have a concern about that.

>> Commissioner, I did want to point out that we did get some really good rates, prices on our fuel compared to the city and compared to the state contract.
so by bidding out we were able to save money.

>> right, and rates are one thing, but safety and health, public safety is another issue.

>> yes, sir.

>> and, of course, I'm a champion as much as I possibly can be on public safety.
and, of course, it seems to be a problem with sun coast as far as not obeying the no through truck traffic-type situations in that general area.
so I have some legitimate concerns.
no way in the world I can support this.

>> we do in all of our bids ask for a bidder safety questionnaire and in this situation we did -- there were no complaint issues on that site for the last five years or with some of the things.
so we didn't see any trucking violations, Commissioner, but I know it's a concern, and this is one of those big social issues that is so hard for to us tackle.

I'm just --

>> I understand.

>> I'm not faulting you for not knowing.
people are telling me and you are in a whole different arena, per se, as far as this is concerned, but it's been brought to my attention and so that's why I'm going to oppose this particular contract.

>> any other comments?

>> I have a question, but I know that the purchasing act does restrict us specifically.
is there any -- I mean for a tract like the tract for which there was much negotiation about no -- no right-out?
right turnout?

>> no leftout.

>> I couldn't recall which side of the street it was on.
is it possible to include for future contracts along with the safety record from tceq also, would it be -- I guess what I'm looking for is a driving record of the trucking traffic coming out, which wouldn't be held by tceq.

>> I'm wondering if we could request just as a standard thing in purchasing contracts that have a great deal of trucking that is -- that has a compatibility issue with the neighbors that we might include that in our evaluation?
it would be something to look at for the future.
I mean we've got -- we're too far down the path on this one, but perhaps if we could consider that, if it's admissible under the purchasing act and if it is -- there's a third party documentation that would be easy to get.

by the way, sun coast did tell us they direct its drivers to leave their facility headed toward 290 east.
if we can remind them that if we are receiving complaints from residents, then we're receiving complaints from residents that in fact some residents aren't doing that, see if that gets any effect.
