then after that let's call up the gilbert road item.
17 is to consider and take appropriate action on the following, a amendment to chapter 82 to require notification regarding Travis County's limited land use authority on the coffer sheet of plat, and b, amendment to title 30 to add section 30-2-87 to require notification regarding Travis County's limited land use authority on the coffer sheet of plats.
and we will call up 19 next.
so that's 17.

>> good morning.
anna bolen and -- Travis County tnr.
since we were here last week we worked with our attorney and with the hba to come up with a modified note that hopefully is ayell to everyone involved.
this note would still be proposed to be put on the cover sheet of a plat, just as we were proposing before.
but I think that we have agreement on the wording of the note.

>> and we can read that into the record.
Travis County consumer protection notice for home buyers, if you are buying a lot or home you should determine whether it ised in or outside the city limits.
depending on state law and other factors, land outside the city limits may be subjected to or local government controls over the development and use of land than inside the city limits.
because of this local governments may not be able to restrict the nature or extent of development near the lot or home nor prohibit nearby land uses that are incompatible with a residential neighborhood.
to be placed on subdivision plats, it is not a statement or representation of the owner of the property, the subdivider or their representatives.

>> this particular note that you just read is something that is pretty much agreeable?

>> pretty much is a good way to say it, Commissioner.
knew I'd get the home builders association folks representatives to come to the table.
but anyway, I want to hear what they have to say as we go through this process.

>> sure.

>> how are you doing hank?

>> just fine.
I'm with the home builders association, president of the home builders association of greater Austin this year.
appreciate the time you've given us to work with the staff.
we had several meeting with them and traded e-mails back and forth and talked on the phone quite a bit and came to a consensus on this note.
we do agree that if the county is going to move forward and put a note on a plat this note is agreeable to us in terms of what it says.
we have several solutions we came up with alternative ways of doing this.
some of the ways of notifying the residents of the county lacks authorities, the county doesn't have the authority to put in a note.
so you didn't even have the authority to put into a note telling people you don't have the authority.
so it felt like this note is agreeable.
it can go on the plat.
we do agree with that.
and I think we're ready to move forward with this.

>> okay.
well, last week you asked for us to kind of delay things maybe until you have an opportunity to -- we wanted to take action last week but I wanted to make sure that you had an opportunity again to come before the court and express your views.
and of course, this is something that we've been working on for awhile.
and I'm really happy that we had a chance to delay this action at least for one week until you were able to get with the staff and the legal folks and your legal folks to make sure that this is something that we can live with.
and of course, incompatible land use in unincorporated areas is a big deal for the county.
and of course, we as Commissioners and members of this court, we fear a lot of things out there.
and of course, a different complaint.
but this seemed to be a step in the right direction within as far as what we can do and able to do.
and so I'm just really happy that you have had a chance to come forth with this.
and again, when we attended the home builders association meeting a little bit ago -- and in fact it was a great, great affair, a great presentation, a lot of things that we had discussed there, and of course at that time I took a lot of pictures with several of your representatives.
so I feel if they're going to take pictures with me they must be going to be supportive of what I bring back.
so I don't think you guys would have had Commissioner Davis in a picture if you would have disagreed.

>> photoshop can do wonderful things for us.

>> so I'm just glad we could work with this now.
and I know that all of us have concerns, and there might be other comments.
but in the meantime whenever the court is ready I'm ready to go and move approval of a and b.
maybe other comments.

>> Commissioner Huber?

>> I only got this revised version this morning.
and I think I'm going to need another week to look at it.
I don't think it's strong enough.
I mean, I appreciate the fact and want to work with the home builders, but I think some language has been taken out of this that signals something to the homeowner that should be considered.
and I would like to have further discussion on that.

so well, as requested normally what we do is honor that.
and of course, that's what we normally do when a person asks for a week, judge, we just delay.

>> did anybody else get this before this morning?
this was the first I saw with this revision this morning.
and that's not long enough for us to have additional conversation if we have questions.

>> I didn't get it until this minute.

>> and I guess if there are concerns about this, and of course since some of the Commissioners just received this information and we've been working all week on this, I guess the point is if there is any additional information that may be needed, I guess we would have to work with staff to see what that is.
and I guess, hank, if you guys -- the home builders association can make yourselves available to look at this.

>> sure.

>> then I think that will be the appropriate thing to do.

>> sure.

>> because I don't know what the other Commissioners have in mind at this point.

>> I think where this note came from, there was the original version.
and then we made some recommended language changes, gave that to staff.
staff kind of morphed everything together and came up with this version an sent it out.
so this came from staff.

>> well, maybe some additional changes that may be necessary.
I don't really know what the other Commissioners have in mind.
but we're going to honor that.
and of course, so if no motion made as far as this is concerned because we just delay this action for another week.

>> we'll try again next week.

>> the question I have for next week that I'd like to have mulled over between now and then would be if let's say that whatever we adopt we wonder two years from next week what impact if any is having.
how would we measure that?
I can wait until next week for the answer.

we'll call 17 up earlier next week.
also what I did was there was a fact sheet that I had staff to produce.
and we all have a copy of that fact sheet on this particular situation.
I've supplied that fact sheet on the compatible land use authority that we do have.
that particular information that is been given to the clerk.
and of course we have that also.
seven bullets on that particular fact sheet.
and you all have copies of that also.
