Travis County Commissioners Court

Item 38
We discussed this morning the contract in item number 38.
that has to be delivered to the seller by 4:00.
I understand that that contract is ready.
and there are pieces of that that we need to discuss probably, but I’m not sure we need to discuss the contract further or do we?
>> I don't think so, judge.
>> did we get the appraisal?
>>
>> [inaudible - no mic].
>> it's not referenced in the contract anyway, is it?
>> no.
>> and did we get the cap?
>> did we get the legal fees capped?
>> john is working on the contract and should have it down here shortly.
>> john is still working on the contract?
>> he's got two documents --
>> [ inaudible ].
>> we're still exchanging phone calls with the seller's attorney, but we expect to have an answer in the next hopefully 15, 20 minutes.
>>
>> [inaudible - no mic].
>> they had that conversation.
he's printing up the documents right now.
>> all right.
will somebody give me a notice when he comes?
>> yes.
>> all right.
In executive session we discussed item 38, consider and take appropriate action regarding potential purchase of real estate in central Austin.
do we need to try to discuss that -- this contract or are we ready to move on it?
if we're ready to move on it, the motion would be upon full execution of the contract, verification of fines and full audit of the claim the county auditor requested to issue a payment for all the contracted earnest money and the county treasurer to replease the payment to heritage title of Austin.
the form of the payment shall be that which provides the most expeditious and this would be $1 million of earnest money to secure the purchase and sale agreement that is the subject of item 38.
>> second.
>> so the motion is as I just read, plus to execute the purchase and sale agreement, and the motion would also be to authorize the county judge to sign on behalf of the Commissioners court.
this document has been prepared for my signature, and the representative of Austin museum of art, incorporated, that was seconded by Commissioner Gomez.
any discussion of the motion?
all in favor?
that passes by unanimous vote.
sorry to rush through this, y'all, but there's a lot contingent upon us getting this document delivered to the seller of this property as we promised to do.
>>
>> [inaudible] one page document that had investment of the escrow amount with the title company so it can earn interest during the feasibility period.
>> and during that period the interest would go to Travis County?
>> correct.
>> and I move that we -- this document requires a signature of the county judge also?
that we authorize the county judge to sign on behalf of Travis County.
seconded by Commissioner Davis.
any discussion on that motion?
and there's only one copy of this.
>> that's fine.
>> sorry to cut you out, but you heard the county attorney say it's time we do it.
>> I’ll make her a copy.
>> thanks you.
>> and we did approve this motion too.
okay.
anything else?
>>
>> [inaudible].
>> I move and Commissioner Davis -- all in favor?
that passes by unanimous vote.
and -- okay, this is -- okay.
so do we -- have we taken all the action we need to?
