16 is consider and take appropriate action on a request for variance to chapter 82.214 a of the Travis County code to allow the spicehenge subdivision to use trinity ground water in precinct 3.

this application would be -- if -- it could be exempt from the subdivision platting process because each tract would be greater than 10 acres if they elected to divide it just in half.
instead they want to divide this in such a way to where one of the lots is like 17 acres and the other is much smaller.
based on the fact that they are agreeing to put a note on the plat saying they won't subsequently subdivide the tract while the suspension is in place and the fact it could be exempt if they just elected to divide it a different way, we recommend that this variance and they can enter the subdivision process.
