we'll discuss these items in executive session, but will return to open court before taking any action.

we have returned from executive session where we discussed all of the items that we announced beginning with number 8.
the matter involving the -- the synagro variance request.
I move to deny based on the following findings, one, synagro failed to meet the burden of proof that it is impractical or a hardship for them to locate an alternative site that meets county siting requirements.
second, that synagro did not provide adequate assurances that they would mitigate all adverse impacts on residents and land adjacent to the site.

33, the matter involving the request from the salvation army to position bell ringers on county property.
during the 2010 campaign, we've asked staff to chat with the salvation army to get various points clarified and we'll have this item back on the court's agenda on November 9th, which will give us an opportunity to take action before the requested campaign for them.
34, the matter involving the bccp, we did discuss that.
staff needs to do further fact finding and have conversations, we will have that back on the agenda on November 9th, 2010.
no other action required today.
35, the matter involving the offer to sell approximately nine acres of land in northwest Travis County in connection with the bccp.

I move that we accept the $4,985 on the table from the liability carrier.
but that we make clear our intention for the not to give up the county's right to collect other amounts due.

I move that we accept the offer to settle for a lump sum payment of $1,100.

Travis County, and others.
first, we want to thank the county staff, mr. Mansour, the risk manager and legal, mr. Nelson and others, for representing Travis County at this mediation and thank them for the fine job that they did.
we do have a -- an offer on the table.
move that we agree to pay the amount of $54,500 to settle the case.

or that company.
but the settlement in full and this will be in change for a full release.

as a follow-up to the hearing we had last week, we did part of the work that we said we would do.
we need to contact some others in an effort to resolve this, including another communication from legal at Travis County with the -- with the attorney for mr. Flores and if the answer to that is, as we hope it will be, then we will run some traps on some other options and have this back on the court's agenda next week.
in spite of our commitment to a limited agenda.
November 2nd election day.
because this matter has been pending for some time and if we can get it resolved, that's probably beneficial for all involved.
so we'll do those steps and have it back on next Tuesday.
and you'll remind us, ms. Porter, of our commitment, in spite of the importance of that day.
42 we got a briefing on the lawsuit of Travis County versus flint hills resources.
no action required today.
put back on at the appropriate time in the future, that may be several months.
43, the matter involving lease and space for the Travis County district attorney at 700 lavaca, we got a briefing and in my view without any action from us, staff will go ahead and proceed.
and at the appropriate time in the future, when action is required by us, it will be put back on the court's agenda, in my view no further action on 43 today.
