Executive Session

Now, why don't we announce that we'll take up on in executive session two items. We have postponed this grievance hearing several times already so we need to go ahead and do it. It's number 29, conduct hearing and take appropriate action on appeal from June 18, 2010, Travis County grievance panel decision in sergio flores versus constable richard mccontain, precinct 3. Pursuant to Travis County code section 9.25 k. This is under the consultation with attorney and personnel matters. And since we discussed the purchase of the automobile, let's announce it and try to get both of these done and then finish the executive session discussions. 19 is consider and take appropriate action on request to authorize Travis County constable precinct 3 to purchase a chevy van, vin number 1 gceg 25 h 9 k 7169133 for $1,000. It will be taken into executive session for security and consultation with attorney exceptions. We're only announcing those two items. We'll come back top story court before taking any -- come back to open court before taking any action and also announce the rest of executive session when we come back.

I move that we delay a decision until next week to give us an opportunity to work on various matters between now and then and to mull over the evidence received today.
and to give another court member who had to leave just before we terminated that discussion, an opportunity to participate if she so chooses.

we also discussed item number 19, I believe the request by the precinct 3 constable to purchase a chevy van from the Texas department of public safety for a thousand bucks.
and for the county to -- let it get reimbursed from the air quality grant funds.

I think the court is on record as indicating that we wanted constables and sheriffs to try to do this for us.
I think it's important for air quality and the investment here is small and reimbursible.

>> although I would comment that considering the testimony regarding -- testimony in executive session as well as out here with regard to the collaboration with other law enforcement that I would suggest the constables look to the other law enforcement for utilization of their equipment.

it is to consider and take appropriate action regarding a reduction in force for slot number 13, constable precinct 3.
and the other items, 24, 25, 26, 27 and 28 will be postponed until next week.
again, that's 24, 25, 26, 27 and 28.
and we will also call up again next week item number 29 the grievance hearing.
now we will discuss only item 23 in executive session and any action we will take in open court afterwards.
and by the way, it's only the legal exception.
it is not the personnel exception.

the matter regarding a possible reduction in force for slot number 13 in the constable precinct 3 office.

>> I move that the employee in slot 13 of the Travis County constable's office of precinct 3 receive the benefits detailed in the Travis County reduction in force policy, section 10.017.
and that that employee therefore receive 22 days of compensation, which will be calculating it from the time of written notice.
