Executive Session

Now 18 b, we announced we take into executive session. We are ready for executive session, right? And that is the to the matter involving the manchaca community center and it is receive update from the manchaca community task force regarding community preferences for use of the manchaca fire hall. This will be under consultation with attorney and real property exceptions. And we'll have some legal questions, i know maybe real estate exceptions, but we'll have it in there under those two exceptions.

>> is it just going to be b or commissioner huber, did you have questions on a as well?

>> well, no, the questions i have that are legal can be settled outside the court. That contract doesn't relate to the legal question i asked about earlier.

>> okay.

>> so just b.

>> we approved a.

>> correct.

>> so b we're taking. 26, we previously announced had been pulled. 27, receive briefing and take appropriate action concerning insurer's request for release in exchange for payment of cost to repair guardrail damage in wiley johns. By wiley johns. Consultation with attorney exception. 28, receive briefing from county attorney and take appropriate action regarding insurer's request for a release in exchange for payment of costs to repair guardrail damage by tea kang. 29, consider and take appropriate action on issues regarding the lease and space for travis county district attorney at 700 lavaca. We don't need that one. We'll be ready for that next week. I'll just post it for open court. 30, receive briefing from county attorney regarding county regulatory over certain development activities. Consultation with attorney exception. And number 31, discuss and take appropriate action on economic development project in precinct 1. And that will be under the financial incentives exception to the open meetings act. Mr. Rhoades is not here today, right?

>> i don't believe he is.

>> we will announce it anyway. If he shows or somebody else, we'll discuss that. If not, we may have to postpone it. We'll discuss those matters announced in executive session, but will return to open court before taking any action.

>> media, there's some question about whether i announced the exception for number 28, the matter involving guardrail damage by tea kang and the exception would be consultation with attorney exception to the open meetings act. As i said, we'll discuss these in closed session but will return to open court before taking any action.


>> we've rushed from executive session where we discussed the thawms we announced consisting of 18-b, the matter involving the manchaca community fire hall. Any action?

>> i think we just directed staff (indiscernible).

>> we'll have it back on the court's agenda at the appropriate time. 25 is the matter involving the payment of cost to repair guardrail damage by wiley johns. Move that we accept the insurance company's offer to pay $2,548.50 to repair that guardrail and give them a release in turn.

>> discussion? By the way, authorize the county judge to sign the lease on behalf of the commissioners court.

>> part of the motion. 27. What did i say?

>> 25.

>> 27. 27. Discussion? That was moved and seconded, right? All in favor? That passes by unanimous vote. 28, the matter involving the damage to guardrails caused by tea kang. I move that we accept the $1,967.50 offered by the insurance company in exchange for ally lease and we authorize the county judge to sign that release on behalf of the commissioners court.

>> discussion? All in favor? That passes by unanimous vote. We did not discuss 29. We did discuss item 30, the matter involving county regulatory authority over certain development activities. As a result of that discussion, we do know that next week there will be another item on the court's agenda, probably more specific wording. And that we will request appropriate action. Any other action required today? And hopefully we'll have that wording tomorrow so we can have it on the court's agenda next week. 31, the matter involving the economic development project in precinct 1. We do think we're making progress on that one. The question is whether we ought to publish -- post a public hearing for next tuesday, the 31st of august or the seventh of september. And hopefully we'll have that information tomorrow. I think that if we go ahead and send maybe e-mails and phone calls to people in the immediate area, it will be okay to have it with one week's notice unless you want to do two weeks.

>> one week is fine. I think they're kind of anticipating this from our discussions.

>> okay.

>> so if the seventh is -- the 31st is appropriate, we can get the word out the best we can if that comes across as such. As soon as we get a final say. Someone need to let me know before we do that.

>> let's try to get that final word before 1:30 tomorrow so we can post it on next week's agenda and have the public hearing on august 31st. There were a couple of people we said we would notify, like the homeowner who came to court for citizens communication.

>> mrs. Roundtree and the other people affected in the area, the neighborhood groups and stuff like that.

>> okay.

>> of course the applicant.

>> we'll try to get that done with an eye to having this on the court's agenda for a public hearing august 31st. In my view no further action required today, just a reminder that there's a work session on thursday with two very important items, the he man mary marion sweatt courthouse and indigent program of travis county. With that i move we adjourn.
