Executive Session

Miss porter, i believe that brings us to executive session. This morning we announced our intention to take into executive session under the consultation with attorney exception item 8, a is consider and take appropriate action on request to approve amendment of economic development agreement between travis county and simon property otherwise known as the domain project. 31, discuss and take appropriate action on economic development project in precinct. 32, consider and take appropriate action regarding potential purchase of real estate in central austin. Consultation with attorney plus receptions to the open meetings act. 33, consider and take appropriate action on issues regarding the lease and space for travis county district attorney at 700 lavaca. On 33, i have not been able to chat with miss lundburg yet. I thought i should chat with her before taking action. I think i should chat with her. That's why i put it back on. I haven't had that conversation yet so unless somebody else has something of a legal or real estate nature, we may as well not call up 33. Okay? And i will promise to chat with her so we'll have it on back tuesday. 34 is to receive briefing from county attorney and take appropriate action in matthew doolittle versus john charles loughran, individually and representative of the travis county sheriff's office, travis county sheriff's office and travis county. Consultation with attorney exception. And 35 is to receive briefing and take appropriate action regarding the lease agreement with texas charter school association at 700 lavaca. Now, we had mentioned the possibility of discussing --

>> the cafeteria -- the cafeteria issues with regard to legal.

>> 35 the exceptions would be consultation with attorney and real property exceptions. This morning the stacking item was number 8 -- no, it was number 7.

>> 7, consider and take appropriate action on the blocking and tacking alternatives for 700 lavaca, maybe a couple questions dealing with the cafeteria. Let's announce consultation with attorney and real estate exceptions to the open meetings act. We will discuss these matters in executive session but will return to open court before taking any action.

Consisting of number 8, the proposed amendment to the economic development agreement between travis county and simon property group, inc. Move that we approve the recommended amendment and authorize the county judge to sign on behalf of the commissioners court.

>> discussion? All in favor? That passes by unanimous vote. 31 is the matter involving economic development project in precinct 1. We did discuss various options and aspects of this project and gave directions to staff, i think, to chat with the other side one more time. And if it looks like this matter is proceeding, that we schedule, and i move that we schedule a public hearing two weeks from today which would be august 31st.

>> and that if based on those directions the response from the requesting party is negative, then we basically don't have a reason to have the public hearing and do not.

>> exactly.

>> is that okay?

>> yeah, i second it judge. That hit the nail on the head.

>> any more discussion? All in favor? That passes by unanimous vote. Number 32 is the matter involving a potential purchase of real estate in central austin. Based on our discussion and my view, no action today.

>> right.

>> anything else from any other party? No action, i guess, would mean basically that it would be a no to the offer made to the county, and basically depending -- because of where we stand in terms of our needs analysis and other matters being considered today. And we would communicate that to the other side. 34 is the matter involving the action by matthew doolittle versus travis county, the sheriff's office and others. And i move that we approve the mediation recommendation for the county to pay $20,000 to settle this matter and with a third party paying the $2,500.

>> discussion? All in favor? That passes by unanimous vote. Now, the last item was number 35, which involved another discussion of the proposed amendment to a lease agreement with texas charter school association at 700 lavaca. Move that we approve and execute the proposed expansion amendment shared with us today which addresses parking and basically finally concludes the expansion rights under the current contract of texas charter school association.

>> discussion? That will get it for us, won't it?

>> it will, thank you.

>> all in favor? That passes by unanimous vote. And there is no further action for us today.

>> yeah, on 7, no action. We did discuss that, though, especially the part that was so important to you, miss porter, the cafeteria. We decided not to change our mind. Move adjournment.
