Item 1
Number 1 is a public hearing to receive comments regarding a request to authorize the filing of three instruments to vacate three portions of old highway 20 south (parallel to u.s. 290 west). Move that the public hearing be opened.

>> good morning, joe gieselman with the transportation natural resources department. This highway, old highway right-of-way is parallel to u.s. Highway 290 west. Just on the other side of oak hill. It has a long history. Used to be a county road, was taken over by the state to make a new -- make it into a state highway many, many years ago. And the county at one point abandoned the road, but did not say indicate the road -- vacate the road, the state department of highways, the texas department of transportation needed to abandon its interfirst. They have now done so, which will allow the court to subsequently vacate its interest in this right-of-way. It's a strip of land that goes into the private properties and they have asked that it be vacated so they can integrate it into their properties. All of that is a long information for the court's request today by the property owner to vacate this old, abandoned right-of-way. And we've had several calls, mainly just inquiring about the nature of the action. I am unaware of any protests to the action.

>> [indiscernible] the public hearing. I need to say something. I didn't -- you had called up and said you wanted a postponement on item 7 before. I went through looking at my notes and i'm just wondering i won't be here next week, for just a short version. I wanted to make sure that -- that the reason for the postponement, i want to be here on that item. Item 7. That's why i'm bringing it up. Why is it being postponed, at whose request?
>> you and commissioner huber want to discuss that over lunch?
>> well, i want to make sure that i'm here, whatever happens, i want to make sure that we can discuss this.
>> i understand, yeah.
>> i want to be here, i won't be back until the 13th. I will be here shortly, briefly for the 6th. Very brief, unless you take that item up early on the 6th, then i won't be able to deal with it. I am supposed to be on leave. I want to make sure that i'm available on that.
>> the gist of the reason is that it's not ready.
>> okay.
>> we can try to call it up early next tuesday. But that -- that means that you will be here more than five minutes.
>> yeah. It's not --
>> tell you what then -- let's -- why don't you all discuss that over lunch, okay? Between 12:00 and 1:30, if we need to bring it back up we will. Legal, i have announced postponement of 7. We are kind of looking at reconsideration. So we may need a legal opinion on whether or not we can bring that back up today.
>> all right, i appreciate it. Thank you.
>> but item 1 would be action item no. 8 today.
>> thank you, judge.
