Executive session items, these items are marked for executive session for various exceptions to the open meetings act act and the items are number 31, receive briefing from county attorney and take appropriate action concerning the mckinney falls parkway road improvement project and the condemnation case involving per sells owned by rks texas investments lp. Under the attorney and under -- consultation with attorney and real property exceptions. Number 32, receive briefing from retained outside counsel and take appropriate action regarding cause number a 09 ca 280 ly. Jay adan ballesteros versus travis county texas and bob vann in the united states district court for the western district of texas, austin dition d.w.i., that's under consultation with attorney. Number 33, as i had mentioned before, number 33 we will only have items b and c under that item. Consider and take appropriate action concerning settlement offers regarding payment for starflight self r. Services rendered to the following: 33-b, alexandra kunert and c, leilani gonzalez. And number 34 has been pulled by request of planning and budget office as there is nothing new to report. And i'm sorry, number 33, the exception on that is consultation with attorney. Did that cover everything? All right. We will go into executive session and be out probably rather quickly.


>> we are pack from executive session where we discussed items 31, 32, 33 b and c. We did not discuss 33 a and d, nor did we discuss item 34. So going to item 31, is there a motion? I move that we accept the offer of settlement in the amount of -- do we have an exact amount?

>> i would have very reluctantly second it had if commissioner davis hadn't beat me to it.

>> i make this motion very reluctantly. This is exactly the kind of thaish we find ourselves in so often where no good deed goes unpunished. Where you're building an improved road that will undoubtedly be a huge benefit to the property owner but instead we are paying half a million dollars for that privilege of doing the good deed. All in favor?

>> [ laughter ] it passes unanimously. Holding our noses. Item number 32, receive briefing from retained outside counsel and take appropriate action regarding cause number a 09 ca 280 ly, j. Adan ballesteros for the western district of texas, austin division. I don't believe there's any action to be taken on that item.

>> no.

>> okay. Item 33, consider and take appropriate action concerning settlement offers regarding payment for starflight services rendered to the following: 33-b, alexandra kunert, any motions?

>> i move that we accept as paid in full subject to the last payment made. How do i say that? I move in recognition of fadesful payments for the last five years on an outstanding balance of $3,008. That we consider that paid in full with the remaining balance of about $1,200 no longer due.

>> does that cover it for you?

>> i'll second that.

>> any discussion? All in favor? That passes unanimously. Services rendered to -- regarding payment for starflight rendered to 33-c, leilani gonzalez. Any motions?

>> i move that with the balance due being $2,921.58, that in consideration of the circumstances that we offer a settlement payment of 500.

>> i second that.

>> any discussion? All in favor? That passes unanimously. Okay. That moves us on to -- do i need to close? Can we do corporations?

>> motion to adjourn --

>> actually, i heard -- as i was coming out of executive session that there is no briefing to be had on number 27, and so we're good with that.

>> we will pull that.
