We will move to agenda item number 2. Receive comments regarding a request to vacate two five-foot utility easements located along common lot line of lot 1347 and 1348 of the amended plat of apache shores section 3 subdivision. This will be action item number 15.

>> the purpose of this item is vacate the public utility easements between the two lots that the owner owns, 1347 and 1348. So that in the future they will be able to build a house that crosses both lots and not have it infringe into the utility easement. We have heard from the utility companies. No one has an issue with this being vacated and tnr does not. We do, however, have a couple neighbors who are concerned, and i will let them speak to that.

>> good morning. My name is evelyn gill berd and my husband and i own a home in creek road apache shores lot 1328 and 1329. This is not our primary home. We also own lot 1327 and half of lot 1315. I drove into austin yesterday and noticed the sign announcing this hearing. Lots 1347, 48, lots 1328 and 27, have a seasonal creek that runs through them. This creek is a natural drainage area when heavy rains occur. There is also an additional water source . I don't know if it's a spring. That keeps the creek wet even during drought. This creek feeds into indian creek that in turn empties into lake austin. I have pictures of the plat showing the path of the creek for your review to get a better idea and overview. After seeing the sign, i investigated the two lots, 1347 and 1348. And i'm concerned due to the steamness --steepness of both of the lots, if they are clear cut erosion will occur which will result in the portion of the creek that runs through my property to be silted. I'm also concerned that this creek being down hill from any future septic system that is needed, whenever you build in apache shores i'm very concerned. I'm here to ask that you delay your decision about vacating this utility easement until we can determine from the owners what their plans are. I'm not here to obstruct them from developing their property, but i am very concerned that what is done is done thought fully such that the neighboring lots aren't damaged and particularly that the creek is not damaged. Last summer when Lake Travis was down more than 50 feet and indian creek was dry a slup months, our creek still had water dripping through it and consequently we had live maiden hair and there's a lot of beautiful trees. At bit of water, deer and wildlife. My yards are xero scaped, so i don't want to lose the few trees that i do have here. We have an experience on broken bough, which is the street on which these lots also are located, where someone came in and clear cut and then put a for sale sign. And the erosion is already happening. So all we're asking is that this get delayed until we can contact the owners and find out what their plans are because if they are just speculators, they could speculate all they want and the environment around us is ruined. Thank you for listening to me.

>> i am robert fowler. I live at 2709 indian creek. Neighboring lots to this party here. We have kind of got some neighbors together that couldn't be here today and we wrote up a of concern and wanted to present that to you also. Neighbors to lots 1347 and is 1348 section 3 in apatch year shores who live adjacentant to or enjoy indian creek running through these lots it's our concern about what will happen to the water quality of the creek if these easements are vacated and a large home is placed on these lots. We would like the court to allow some additional time to enable tceq and/or lcra to come in and take a look at the impact a large home might have on this creek. When it rains a large amount of water flows over the street and through the property and that is up above where it rolls down. Subsequently into indian creek. This flow continues through our homeowners community natural habitat greenbelt and into lake austin. Unfortunately, due to work, we are not able to be here to attend this hearing and ask our neighbors who are able to make it to voice our concerns. And we have signed by seven of our neighbors.

>> because we want to hear these things and need to hear them before we take action. I guess, anna, you made contacts with both those folks. And i actually would like to request that we postpone this action item for two weeks.

>> any issue at all with the time frame?

>> not to my knowledge. And we can certainly get the owner that is requesting the hearing and neighbors together in that time frame.

>> i whole heartedly agree and imagine commissioner davis would to. That is exactly what public hearings are for.

>> to when would it be appropriate to reset? At least, of course, we need to speak with the property owners who are urging this. But what do you believe would be the likely reset date?

>> i think within two weeks we can certainly have it on. Fan not, you know, we would talk to the judge's office. But i would anticipate we could be back in two weeks.

>> why don't we pencil it in for two weeks. And ms. Bolen will be able to contact you all and let you know what the date is for certain.
