Miss porter, according to my calculations, we are to executive session. Let's wake up the lawyers. 21, consider and take appropriate action regarding selection of and funding mechanisms for purchase of open space. 22, revised language, consider and take appropriate action on acquisition of approximately 579.61 acres of land in northwest travis county in connection with the balcones canyonlands conservation plan. Real property exception. Let's also announce consultation with attorney for item 22. 23, consider and take appropriate action on acquisition of approximately 15 acres of land on fisher hollow owned by javier saldivar in connection with the balcones canyonlands conservation plan. Real property and consultation with attorney exception. 24, consider and take appropriate action regarding the potential purchase of real estate from travis county realty for property located at 700 lavaca street. Consultation with attorney and real property exceptions. 26, receive briefing and take appropriate ax regarding cause nument a-09-ca-280-ly, j. Ballesteros versus travis county and bob vann. Consultation with attorney exception. And number 26, consider and take appropriate action on settlement request from sealy heatherwyld in its dispute involving wells branch parkway. Consultation with attorney exception to the open meetings act. We'll discuss these items in executive session but we'll return to open court before taking any action.

Now, let's call back to order the voting session of the travis county commissioners court. This morning we convened in executive session and discussed all of our executive session items, except one. The one we did not discuss is number 21, which we will discuss in executive session at this time. 21. Consider and take appropriate action regarding selection of and funding mechanisms for purchase of open space land in precinct 1. And this discussion will take place under the consultation with attorney and real property exceptions to the open meetings act. We will have the discussion in executive session. But will return to open court before taking any action.


We have returned from dpetion, executive session. 21 we discussed. 12 is the matter involving a potential purchase of 579.16 acres of land for the balcones canyonland preserves conservation plan. Commissioner huber?

>> i move that we authorize the staff to offer 7,445,000 and negotiate with the family for access for the purchase of this property.

>> discussion? All in favor? That passes by unanimous vote. Item no. 23, is a potential purchase of 15-acres of land, on fisher hollow from javier vsaldovar in connection with the bccp.

>> i move that we authorize staff to make an offer of 388 the $60 for that parcel.

>> discussion? All in favor? That passes by unanimous vote. 24 is a matter involving the potential purchase of -- of -- of 700 lavaca street. Property we did have a full discussion, probably no specific action today. We will have it back on next week with separate items dealing with various aspects of this issue.

>> there was one, do you want to go ahead and put off that one -- that one tenant issue where -- where -- the request to consent to -- to allow them to enter into contract documents. Or do you want to put that off to next week as well, separately?

>> can we do that if we don't own the property?

>> they -- the contract -- the contract does require the county to -- to consent to certain requests. For -- for -- whether it be an extension or -- or new lease or whatever, this is one that -- that the -- that the broker indicated it would be okay.

>> i would prefer a specific item or a subpart if we have time.

>> i think we do.

>> i think that way the record will be a whole lot clear of what we are doing. Plus we would get the name and the rest of that in the -- in the subitem.

>> so we will have that back on next week. One of the separate items that we have dealing with -- i'm saying separate items, but separate parts of one item that there will probably be multiple things that we need to consider. 25, is the -- is the lawsuit -- lawsuit by -- by constable against travis county, bob van pending in the western district federal court. We received that briefing. There's a -- there's a -- status conference tomorrow. And let's have it back on next week. Just if case we need it. We will take it back up next week. Run it by ms. Thomas, ask us to do this for us again. 26, the matter involving a -- a -- a settlement request from -- from hetherwild, lp, we did discuss this in full. The concept seems all right. And seems to me to make sense to ask the attorney for one of the parties who made the request to put together a settlement -- settlement documents, let us look at the specific wording, trying to figure out what to do. Can those just be general directions to --
