Speaking of consent in a1, a1 is to consider and take appropriate action on the following relating to environmental review.
good morning, christy moffitt Travis County field offices.
we came to the Commissioner's court and presented to you the environmental review report for the lava lane project which will approve the unaccepted portion of that road and also extent it to allow emergency transportation to be able to go down that road as well as school buses.
so there is a public comment period that's required.
we placed an advertisement in the newspaper on March 19th, beginning March 20th, through the end of yesterday.
there was a public comment period for anybody who had any questions or concerns about the environmental review report.
we received no comments.
and so there were no further considerations that we have for the court to consider prior to certification of the environmental review.
so that takes care of a.
b is, we are requesting that the judge sign certify an official of the report and there is some forms that we have identified in the report that need to be signed by him so that we initial officially certify the results prior to sending it to hud and then c is there is a form when we submit a form to hud, we are requesting that they authorize release of funds, so when we submit the report, hud isn't actually approving the environmental report.
if it ever were to be challenged it is the judge's responsibility sore the county's responsibility to be able to defend that report.
what we are asking from hud with our submission is that they release our funds by us saying we have fulfilled our obligations environmentally, so we are also requesting that the judge sign that form as well as certifying official and all of that information is in your packet.
and I am sorry, there is also a second comment period that starts.
it will start from the day that we send that request to hud and it's an additional 15 days.
we anticipate that process with end on April 26 and at that time we are expecting to have a release of funds from hud.

>> so the 15-day period starts running when we mail the form to hud or when hud receives it?

>> when hud receives it so we say on or about because it is an estimated date.

>> okay.
the budget of this project is $475,000?

>> yes.
that is an estimate, too.
right now the court has approved funding for design and also acquisition of right-of-way which we are still looking to see if we requested that permission from the court because we are using substandard road criteria but we will use cost savings from apache shores subdivision to fund the construction, which the court approved last August and also we will be putting in any additional dollars in the py program year 2010 action plan, we will be coming to the court in may to request if additional funds are needed for the construction.

>> yes, from hud, yes.
yes, that is correct.

>> judge based on the report from staff, I move for approval of a, b, c.

>> and authorize the county judge to sign the documents on behalf of the court?

>> yes.
