we have worked our way to number one.
number one is to receive comments, a public hearing, by the way, on a plat for recording in precinct one, resubdivision of subdivision lot 4 block a, two total lots.

as you say, we had a lot of emergency workers here on number 3 and thought it about esto get them back to work.

the purpose of this resubdivision that we are having the public hearing on is to add a portion of 1.7 acres to some existing neighboring plats.
in 2008, the balli subdivision was approved.
and point of 7 acres from this resubdivision would be added to one of the lots in that subdivision with the remaining one acre being final platted for the owner that sold off the point 7 acres.
at this time, however, even though the plat meets our requirements, both owners have not signed the plat so we are not ready to recommend approval.
but aside from that, this plate otherwise would meet our requirements.

and we would proceed with the public hearing because--

>> okay, anybody here to give comments on item number 1?
if so please come forward.

>> judge, before we close the public hearing, I want to make sure that the folks understand that this particular subdivision is located within the kenny ridge subdivision.
as you know, we as a court have struggled over the years to bring water and uplift this particular subdivision out of a colonial status, in which it is at present out of a colonial status.
i want to make sure that when these lots are sold, I want to make sure that the persons purchasing these lots understand that we do not want to revisit another colony where by purchasing a lot and not having caps associated with that.
in other words, there will be a tap required if they are using for residential or other purposes.
i want to be sure that happens because quite a few lots out there probably still for sale.
and since that is the case, I think the purchasers and sellers of these lots need to make sure those persons purchasing these understand that if they have structures there, we will require taps.
that needs to come across I think very strongly because we do not want to see and revisit the establishment of another colonial time situation at kennedy ridge.
so I want to make sure that point gets across very, if you can get two signatures, fine, but that point needs to be brought across.

this is posted for action on item number 6.
what is requested?

>> I would request that we pull the action item and in the event that I get those signatures, we'll put this back on the agenda for action.

so no action will be taken on the matter that we are having public hearing on in item number 1.
