wanted to give you your report card on the txi agenda item.
you scored a f minutes.

there is room for improvement.
the time comes when silence is betrayal.
i think the citizens in the community are going to ask the county for a contract.
some of you are familiar with contract for america.
contract for the citizens of Austin and Travis County.
this contract, some of us are in prayer and fasting.
and we are requesting a presidential inquery from president obama.
i had a communication last night with the secretary of the u.s.
department of interior around seven o'clock, ken salazar.
his number is 1-202-208-3100.
some of us have contacted oprah winfrey.
we want to see if she will purchase this land for us over here and name a fishing place, park over here in honor of Ron Davis.
we're also working on issues with our county government that doesn't seem to listen to us, and tells us all the thousands of reasons why they can't do anything about txi.
we would like to divert your attention to the things that you can do about txi, such as enforce the laws that we do have with these 18 wheelers, have your taster is cost pools, Travis County sheriff, anybody that you have rely on the resources the that you have and enforce the laws by the trucks by these contract drivers.
we want an updated process.
we would like something on the agenda.
we want Ron Davis to be appointed to the comprehensive plan and the campo board.
he has been the only person out of the 12 elected officials here that has been a premiere example of how to represent the east side.
and we want a resolution passed which judge Biscoe chairs the campo board now, at least the county and the city of Austin acknowledge the citizens have asked for boycott against tex and ask the other agencies on the board if they are not willing to at least boy could it txi to at least acknowledge we have called for a boycott on txi.
we also want tax protest policy in place with our tax office here at the county level.
includes a $10,000 free for asking reduction in your property taxes in Travis County, those affected by living in this area.
there's too many things to discuss about what we are requesting.
but stay tuned.

i'm desi andrews.
and I'm here to talk about the constitution like I always do.
once upon a time when we had a republican in this country, which by the way we are guaranteed, all officials who took public office had to put up a surety bond to indemnify the people against malfeasance.
they had a risk.
and therefore, they pretty well towed the straight and narrow because a bond in those days was a free hold.
when they misbehaved they lost their property.
depending on the office, they had to put up other people's property as well.
other people had to stand a surety.
since this government has been turned into a democracy, and everything is statutory, there are certain elements and conditions of elected officials when they take office.
they have to meet certain criteria.
among those are bonds, others, the statement of office under article 16 section 1 of the Texas constitution and the antibribery oath.
in the old days that would have cast others bit out of their pocket.
in this day and age any public official can meet those qualifications simply by steining their name on a piece of paper and the taxpayers pay for the filing and the notary and the paper and the bond.
and it has come to my attention that hardly anybody has a bond n of oath on file.
than criteria can be found in the Texas association of county work book that says what the bond is, the bond and oath, and where it is that it has to be filed.
and case law shows that, case opinion, shows that if you don't have the proper criteria before you enter the office, that you dent sit with the cloak of the office.
so rather than simply say that people holding their offices are engaging in fraud, I won't do that.
i'll just say that anybody who has entered an office and assumed any powers of the office without first filing the criteria, which I think maybe this is, to you, judge Biscoe, because you haven't been able to produce your oath and bond, and the county clerk, the district clerk, these people are sitting without the protection of a bond.
they don't even have to do it to the people anymore but they have to do it to the governor or the county judge, the county commission.
so, I'm just informing you that thomas jefferson says it best whorks will govern the governors?
there is only one force in the nation that can be depended upon to keep the government pure and the governors honest, and that is the people themselves.
they alone if well informed are capable of preventing the corruption of power and restoring the nation to its rightful course if it should go astray.
they alone are the safest depository of the ultimate powers of the of government.
i want to give the caution that if you are exercising without the requisite criteria that you have to post file and put in public notice that you are doing it individually and your property is at risk instead of a surety bond.

i come to you as a man, brian hunt here in Travis County.
i will also make you aware of the notice posted in the courthouse yesterday and served on annie dubuos and amelia rodriguez.
it goes in line with what ms.
and druce was speaking about.
in 2005 there is a death in the family that created a situations where I was invited to court by torns in.
they don't practice law.
i can say this with experience.
i have gone to court after going to the law library and researching myself with help of others.
i'm an ed it caed man.
i have an engineering degree from the university of tennessee.
my grandfather always told me, a have to is a good maker.
not to be codependent.
learn for yourself.
so I go to the law library.
i appeared in court doing the best I can with my limited knowledge, not going to law school, not being a member of the bar association, and was able to stay in my home for four years and not pay property taxes because the attorney did no the have a client.
in the end, I was out numbered and my property was stolen by and through theft by bar card.
and also played professional sports.
the position that I played was to quit was not in my vocabulary.
so I was very confused about this process.
so I would go in front of judges and say my grandfather brought me to the courthouse, and you petitions to regress grievance against the government if you have been damaged.
i brought this up to judge flowers, who is retiring this month.
i told him I was confused.
can you help me.
he said stay confused, sir.
i thought, this was a public servant.
then I told him I was very confused.
and he said remain very confused sir.
he kept inviting me into the bar and I wouldn't go because I know what the door is over to the left.
so this man put my brother in jail.
after he dismissed his charges criminally.
i went on my own and helped him get these charges dropped.
not depending on a county attorney.
so in closing, everyone of you people are sitting in the name of the authority of the state of Texas.
supposedly.
i have not found any documentation that you have any authority to act in the position that you are now sitting.
i have a call into the provo marshal at fort Sam houston.
when we no longer have a government of a civil nature that is who you are to call.
you are now on notice.
none of us guys have a proper oath in office.
if you can show it to me, I can say I reserve the right to be wrong.

let me just for the record, those bonds were executed and approved by the Commissioners court.
and we have the date that that action was taken.
but you are right that I have not been able to find those three bonds.
we will look today.
i will give you a written response.
but we did get the minutes of the Commissioners court on the day that the bonds were approved.
but we cannot find the original bonds, which should be on file here at the county.
so we will still looking at that.
haven't given up net.
but by the close of business today, I will reach a final conclusion on that and notify you in writing.

from the city point of view some officials are not questioning whether agency are obligated to pay any of the remainder due to the city under the agreement of road infrastructure repair.
it was close to $80 million when I first brought this issue last year.
there is an obligation according to chris riley, an attorney, he has a current council member, capital in e tro obligation to the city are legally enforceable.
i say this.
it is true.
i am not an attorneys a former bailiff in the courts.
i have studied a lot of legal issues.
i choose not to bring some here because it is not the proper avenue at this time.
i want to say this is a fiasco that should have been stopped anening will time.
i brought these issues many times in the last year.
i brought it to Commissioner Gomez and council member or mayor pro tem mark martinez and all the board members of the former capital in e --metro board.
it should have been brought to the feds to investigate a long time ago.
they did a darn good job.
i heard the mayor say we are going to have an audit, I haven't seen it yet, independent audit.
Commissioner go I know you read this, you were part of the capital metro board as director at the time.
it is not good.
it is public funding.
i leave it at that.
aisd wants to lay off teachers and employees.
what is that going to do to the quality of education to students?
students need a lot of help now.
lewis iaand I were instrumental in 2005 and 2006 in lobbyingel lt.
governor, speaker of the house, to get the tax test anabolished.
starting 2011, no more tests.
we can get students tested on the subject matter.
that is the best case scenario to get the students educated and graduated and become a proper and positive productive member of society to be able to compete.
get a good beige.
poverty is rampant.
you hear about the rampant to count the homeless.
it is not going to happen.
i say this again, a society's worth is measured by its treatment of the last fortunate.

roadville hutchins junior, you know.
and to show that where this reference date my son was released on may 14, 1993, and I'm here to show today that my son was not released on that date.
and here is the proof ust a.
he was still incarcerated on June 2, 1993.
and up under this it says may 17 1993.
he was transferred to the 299th district court and was set for designation of attorney and trial.
well, judge, bob perkins ordered my son to be released on June 10 1993.
and he never was.
he was illegally transferred into wacken hut from there to state prison.
they sent this to you, judge Biscoe, I have proof of.
i have been digging and getting support.
and here is where my son was still incarcerated June 26, 1993 and he is up here where it says the grievance, he was writing a grievance trying to typed out why was he still in jail, Travis County jail, over June 10, 1993.
my son is innocent and I'm here to call for his, to see if I can't get money from that funding because my son served 15 years day for day.
he never was released on parole.
it said no parole.
the file that I told you, derrick bateman created.
this is where it says pretrial.
this is where it shows my son was still incarcerated in June.
so he never was released like I said.
and this is that other one.
i'm here today also to talk about the support that people have been giving me.

i'm a street minister in Austin serving in that capacity for some years now.
i was asked by a friend in recovery to come witness on January 6 of 2010, a proceeding that they were going before judge hurly in the district court for.
it was my understanding they were going there to discuss a motion for discovery filed by the attorney that they were opposed by, hopkins or something like that.
i had never met any of these people before.
went into court.
i was taking notes.
some things happened that I found incredibly disturbing because first off everything was done off the record.
what was addressed in the court was supposed to be the remittance of the motion for discovery to answer these questions that brian paul and dessy andrews had provided for this gentleman.
some of these answers were matters of public record.
so for one, for plaintiff or accused to have somebody on the counterpart ask him to do their research for them is kind of inappropriate, I believe.
meaning they are supposed to be doing their own work for their own discovery, what have you.
if it's a matter of public record, it shouldn't be put on somebody else's shoulders to provide that information.
and they point the out it was a matter of public record.
what I'm getting to, everything was askew.
i had never seen a court action handled like this before.
brian paul hunt, whenever the fellow was given hoping statement was saying is he giving testimony?
he says no, he is giving an open statement.
he said he wanted it entered into the record.
none of this was entered into the record.
the fellow didn't even have any kind of documents or anything to plead his case.
and he stated that in front of the judge as a matter of fact.
well, the judge had told him that he would get his chance to speak.
well, everybody got to make an opening statement.
hopkins and ms.
andrews and brian paul hunt never got to make an opening statement.
the judge recessed and came back with an order to read.
he said he never got to read his opening statement.
she said I thought ms.
anne draws did that.
he said no, you told me explicitly I would get my chance.
she went ahead and let him do it.
he requested it be on the record.
she wanted everything to be off the record.
it was a red flag ap the way through.
he said, I want mine on the record.
she said oh, you know.
he didn't get through giving his opening statement.
and the judge was reading this order on top of what he was trying to say.
the lady was taking the notes, you know what I'm saying.

>> the stenographer was trying to get, was confused.
it was mayhem.
but several times ms.
andrews tried to give her a bond.
you know whether I'm saying, to bond the action.
because nobody had produced a bond.
that was thrown back at her.
but the thing was, later on whenever it was entered in the record, it had nothing to do with what was addressed in court that day.
it's the most disturbing thing I have ever seen in court.
they pointed out all these people don't have others of office or antibribery statements on file and bonds.
i find this disturbing.
i think to me that constitutes somebody impercent nating an officer--imperson ating an officer of the court.
if you are not performing this function.
everything that has been entered into evidence and everything they have done stands for nothing.

and I'm officially asking for the answer to foyehs that have been put forward with regard to the txi permitting process.
there are specific requests, two of them, on file.
the written portion of my testimony is the arm dillo award and I think that the vote of the approving permits warrants getting this award.
at eleven o'clock today, if you can find an armadillo scratching and happening to relieve you of this award, Commissioner Huber, I apologize that I'm awarding you also, along with mr.
davis, who voted in favor, or voted to deny the approval of these permits.
you see, there is 72 percent latin oh population base in the immediate area surrounding the 4501 hampton, dunlap road, zipcode 78725.
that population base did not get address by this.
they requested, they wanted to come, but due to the fact that they speak spanish for most part there's a deep concern in the community.
i think that the Commissioners court needs to address that and consider retracking the per permit that was approved.
txi, I report they have gone on on the 29th, and they did follow.
they apparently have purchased the property and now make applications for permits and defend the matters in the name txi and not in the matter of the estate from which the land is.
i have those on file.
i also received from the department of army corps of engineers a report here that makes me think that we as citizens allowed the county to come to an action, make an action, make a decision, without all of the information.
the black tip, the black tip arrow heads passed in front of you on the 12th, they have been declared by dan potter, archeologist for the Texas he is trick --historic commission, as being 30,000 years old.
it's a significant tourist attraction to be able to keep those.
but now we have a permit approved by this award winning body.

there have been various people declare I don't believe this is possible.

the government campaign in the radio station and naacp insurance business is just an example of how negro betray and la tenos in exchange for money or job from higher power.
for real crimes, you can start with those who provide smoking through the human rebel through the changes left of johnson high looking for business and finding business, in full view of superintendent.
dps long engaging in identity theft for insurance investors, jerking blacks and hispanics out of arts in favor of caucasians.
road blocks and stop and search or municipal judges on charges because as a judge, judge Biscoe you have the ol gages to guard the constitution above all.
finally, I want to share something with you.
i visit museums and art exhibits once in a while and time blacks and hispanics are so absent.
if they could be represented by the members of Commissioners court by height, ms.
Eckhardt and ms.
Huber would be ten foot tall.
ms.
Gomez, 12 inches tall.
both judge Biscoe and mr.
davis, four inches tall.
that means for you to get noticed in a museum, you would have to stick your heads out of either, misEckhardt or ms.
Huber's purses.
