Travis County Commissioners Court
January 26, 2010,
Executive Session
Now let's call back in order the Travis County Commissioners court.
this morning we discussed item 26 and took it in open court, hinted that we may go into executive session with it.
I hereby declare there's not a need for it.
right?
26?
>> right.
>> I forget why I said he might take it back in there.
john that means that we don't need to.
24 is to receive legal briefing and take appropriate action on revision of policy reeltd to family and medical leave based on final regulation promulgated by department of labor and revisions to law, consultation with attorney, exception, 25, consider and take appropriate action on brokerage services agreement with ugl equis corporation, consultation with attorney, exception, are we ready on 25?
>> yes.
>> equis?
so 24 and 25 were taken into executive session and -- there is no --
>> 9.
>> that's what I couldn't think of.
9 is to approve modification number 4 to contract number 07t 00145ld, scs field services for 290 eastland fill operations and maintenance services, and this will be taken into executive session under the consultation with attorney, exception to the open meetings act.
so there are three items. Ms. Porter, if we are not out in 20 minutes, please knock on the door.
we'll discuss these in Executive Session but we'll return open court before taking any action.
We have returned in executive session and discussed the following items, number 9 the matter involving the modification to a contract with scs field services for operations and maintenance services at the 290 east landfill run by Travis County and a possible conflict of interest issue was raised with us, that involves rusty fusilier, who works for ses field services.
the motion?
>> I move approval of the modification.
>> [indiscernible]
>> oh move approval of the modification of the contract.
>> discussion?
>> explain that I guess for the public.
>> it's a modification of an existing contract that dates back to 2001 the modification is to include services from ses to look into our cap as well as subsideens issues.
>> does that include the removal of
>> [indiscernible]
>> my motion does not.
>> does not.
>> does not.
>> okay.
okay.
all right.
>> discussion of the motion?
all in favor?
>> well --
>> show Commissioners Eckhardt, Huber, Gomez and yours truly voting in favor.
Commissioner Davis?
>> I will have to abstain on this.
I was -- I'm going to have to abstain on this one.
>> abstaining.
>> just can't support that, per se.
>> okay.
number 24 is a briefing that we received, another briefing, regarding revision of a policy related to family and medical leave based on final regulation promise gated by -- promulgated by department of labor and recent revisions to law.
we were given written materials to review, we are told if we have the matter back on the court's agenda, for action on February 16th, it would be good and so that's our intention.
and anything else on this item today?
25 is the matter involving the brokerage services agreement with ugl equis corporation.
we did get a briefing.
was action expected today?
further work?
next week or week after?
>> a week.
>> in two weeks is February 9th.
>> 9th.
we did not discuss 26 in executive session that time because we did not announce it.
we did discuss it this morning and indicated that we might have a follow-up issue, the one issue really is, by the way this is the matter regarding the potential purchase of real estate in the central Austin area.
we received two press releases and the question really is whether we should use the one that comes from the court.
and what it does basically is just to list all court members as contact persons and it has generally the information that we shared in open court this morning.
our goal would be to share this press release with a long list of media reps in central Texas, I move that we just send it out with everybody's name on it, Commissioners court.
>> second.
>> that we ask the staff headed by -- by dee eckstein to get this to the designated media as quickly as possible.
and this afternoon that may well mean e-mailing, faxing, and the other ways that you get materials distributed to media, local media, expeditiously.
that's the motion.
would that cover everything or is there something else?
all in favor?
that passes by unanimous vote.
thank all of the core team, our broker, legal and others that worked on this delicate item for the last several months.
there's still a ways to go, but we are way down the road.
okay.
