Executive Session Items

That brings us to executive session, right, ms. Porter?
one question is whether we take 14 into executive session.
Commissioner Eckhardt?
what's your view on that?

>> I would ask that we do.

>> 14 is to receive briefing and take proposes action regarding the design and implementation of protocols for txi mining operation in eastern Travis County.
this will be under the under the consultation with the attorney open meetings act.
25 is to receive legal briefing and take action on provision or policy related to family and medical leave, based on final regulation, promise you will gaipted by department of labor and recent revisions to law consultation with attorney exception, 26, consider and take appropriation action regarding contracts between Travis County and the star of Texas rodeo.
consultation with attorney and real property exceptions.
27, receive legal briefing and take appropriate action regarding the potential purchase of real estate in the central Austin area.
consultation with attorney.

>> we also want to make that under real estate to give flexibility on the conversation?

>> 27, in order to give us some flexibility, and please one of our assistant county attorneys, we'll announce 27 also under the real property?

receive legal briefing from the county attorney and take appropriate action in the matter of Travis County versus flint hills resources l.p., and koch pipeline company, l.p., consultation with attorney.

>> and a 1, consider and take action on brokerage service agreement with ugl edwards corporation.
consultation with attorney, exception to the open meetings act.
we'll discuss these matters hopefully within an hour and 7 minutes, but we'll return to open court before taking any action.


We have returned from executive session where we have discussed the following items. Number 14, the matter involving monitoring protocols.
we did get legal advice on that item.
in my view --

>> to direct tnr, county attorney and the purchasing department to develop a request for professional services and an estimate of costs to assist Travis County in identifying experts for the development of monitoring protocols for the proposed txi mining site in eastern Travis County and for development of standards for buffers between industries and receptors.
and further to direct pbo to identify potential sources of funds for contracts pursuant to this effort.

any discussion of the motion?

there are a few things that I asked for that I think I need to see.
I'd like to see those things.
I'm not going to support this today.

>> I'm willing to withdraw the motion and have it for next week.

>> that would make more sense to me.

>> it would make more sense to wait a week.
I see that joe and mr. Webb are antsy about moving, but -- can you wait a week?
motion and a second are withdrawn.
we'll have this item back on the agenda next week.
and I doubt that -- I think we'll still be waiting on the main item, number 13, because their meeting is supposed to be, what, about two and a half weeks away.
so do we want to just take the monitoring item -- it's fine with me.
do we want to go ahead and take it alone before the other one?

that would be my request.

>> then we'll have 14 back on next week.

>> 25 is a matter involving the changes to the department of labor's regulation regarding family and medical leave, especially regarding veterans.
that impacts county policy.
we did get briefed on this.
in my view no action required today except to have it back on.
we'll be ready to act in a week or two, we think?
let's say two weeks.

>> because I think we need to see some language, don't we?
that will give our lawyers an opportunity to come up with draft language to consider.
so we'll have that back on in two weeks, and that's the 26th?

>> yes.

January 26th.
and the 26th is the matter involving the contract between the Travis County and the star of Texas rodeo.
if our proposed change that the last one that I understand is under consideration is acceptable and the document comes back, do we want to just go ahead and approve it --

>> yeah.
if it comes -- we've got until Tuesday on this.
Commissioner, what do you think?

>> I don't see why we couldn't approve it if it was subject to the last provision and authorize you to sign.

>> leave it on until next week?

>> well, if it comes back with the change that we recommended, the last one, a signed document, the motion I guess is to authorize the county judge to go ahead and sign it.
so no need to have it back on the court's agenda again.

>> well, if we get an affirmative answer between here and then.

>> that's what my motion is.

>> I'll second that then.

>> any more discussion?
for the public, this is changes that we've already seen that we made on the other side, one little change still being considered.

did I indicate earlier that Commissioner Gomez had to run to another commitment and she will miss the rest of this meeting?
27 we did get a briefing on the potential purchase of real estate in the central Austin area.
and some contract language to look at.
and so we'll have another opportunity to consider that.
in my view no action today.
is that agreeable?

and we do need it back on next week, hopefully for action.
that's January 19th.
28, the matter involving Travis County versus flint hills resources and koch pipeline.
we did get a legal briefing on that one.
it was good news requiring no action.
and legal will ask us to put it back on if necessary at the appropriate time in the future.
a-1 is the matter involving brokerage services agreement with equis corporation.
we only had a brief discussion in which we decide that had this item could wait until January 26th.
so we'll discuss it more fully and hopefully have some draft language to consider at that point.
on number 15, the one that we skipped this morning, joe, staff asked that we extend the contract -- the comment period on 15.
and 15 is to consider and take appropriate action regarding proposed revisions to Travis County code, chapter 64 and 82 relating to storm water management requirements in the Lake Travis watershed and other unincorporated areas of Travis County.
staff basically requested that we formally extend the comment period until what date?

>> 30 days?

>> another 30?

>> to what date?

>> is that February 11th?
would that be Monday?

>> that's a Thursday.
