Travis County Commissioners Court
January 12, 2010,
Item 3
Number 3 public hearing to receive comments regarding a request to authorize the filing of an instrument to vacate two five-foot wide public utility easements on either side of the common lot line between lots 3 and 4, block 3, Austin lake estates, section one subdivision; and a drainage easement of undefined width, which traverses lots 3 and 4, block 3, Austin lake estates, section one subdivision
>> move for public hearing.
>> second.
all those in favor?
this passes by unanimous vote.
>> the owner is requesting that these easements be vacated so that they can cite a proposed house and septic system so it will not encroach into the easements.
again we have heard from the utility companieses that there is not a need for the easements and we received drainage information from the applicant's engineer that we reviewed and we agreed with their conclusions, staff recommends this proposed motion.
>> would anyone like to give testimony or commentses during this public hearing?
number 3.
if you give us your name we will be happy to get your comments.
>> yes, sir.
>> [indiscernible - no mic] we are the owners of the lots in question.
>> okay.
>> if you speak into that microphone, mr. Middles.
>> yes, basically what I want to say is this -- in terms of the whole lay of the land and everything, change is nothing, except it defines an easement which was the center line easement drawn on a map as a dotted line in 1959 which has nothing to do with where the water actually goes.
we are also working with your staff because we are also so blessed to be in the city of Austin's etj, so we have to comply with all of their regulations for septic and that stuff so I guess my message is this won't change anything or affect anyone.
>> therefore, you support it.
>> I support it.
>> would anyone like to give comments during this public hearing?
if so, please come forward.
>> move public hearing.
>> second.
all those in favor.
this passes by unanimous vote.
this is action item 17 which would be recommended include on consent agenda in a few moments.
