Thank you, Commissioner, that takes us to executive session, doesn't it?
this morning we announced that we might take item number 7 into executive session, that was matter, john neilly, involving the request for a demand rather for installation of wood privacy fencing between residential single family lots and the anderson mill road right away from the following landowners, michael lavery, james wenzel, and patricia porter, we will take it under executive session with consultation with attorney exception.
thirteen we will discuss, receive legal briefing and take action on revision policy related to family and medical leave based on final resolution, promulgated by the department of labor and recent revisions of law.
and 13 will be the consultation with the 13.
and number 14.
consider and take appropriate action on the possible disposition of a .0031 acre (135 square feet) triangular tract of unused, excess right of way adjacent to lot 113 on lakeplace lane, and appoint a Commissioner of sale consultation with attorney and real property exceptions.
15.
consider and take appropriate action on a proposed fourth amendment to the existing purchase contract for the sale of county-owned property located on johnny morris road to balcones resources, inc consultation with attorney and real property exceptions.
16.
consider and take appropriate action regarding contracts between Travis County and the star of Texas rodeo.
consultation with attorney and real estate exceptions and on 16 we just put it on just in case there is a reason to take action, we will get an update.
17.
receive legal briefing and take appropriate action regarding the potential purchase of real estate in the centra Austin area.
consultation with attorney with exception to the open meetings act.
we will discuss these items in executive session but will return to open court before taking any action.


>> we return from executive session where we discussed most of the items where we announced beginning with item number 7, the matter involving the request for installation of wood privacy fencing by three residents.
affected by the anderson mills road project.
i move that we act on the following, in an effort to resolve and settle demands for county installation of wood privacy fencing along anderson mills road between residential lots owned by michael lavery, james wenzel and patricia porter and the public of way, Travis County extends settlement off to each to include survey and staking of the right-of-way line, and the following sums of money -- following sums of money, for mr.
michael lavery, sum of $1,430.
for james wenzlef, the sum of $3,600, and for patricia porter, the sum of $2,470, in addition, the Commissioner's court authorizes the staff -- county staff and the county attorney to negotiate and have the budget --

>> have the county judge execution settlement agreements reached with these parties, if any, and by the way, these amounts are supposed to represent 50% of the claims, and we do this in light of the appraisals that we did, their responses, and our ult quailitily settling the three cases for significant amounts over and above the county's appraisals.

we did not have an opportunity to discuss item 13, we frankly ran out of of time and therthan come back this afternoon, we will do 13 next week, earlier in the executive session.
john let the affected assistant county attorney know that 14.

i move that we authorize the sale of this property.
and that we appoint Commissioner Huber as the Commissioner of sale to get this done.

number 15 is a matter involving county owned property on johnny morris road and our agreement with balcones resourceses inc., move that we extent the contract outstand to go July 30 of 2010.

seventeen is a matter involving potential real estate in central Austin area.

we will have it on next week for appropriate action and if we can get staff to do actions consistent with our discussion, more in the line of probably direction than anything else, is that right lawyer hilly, we will have that on next week if we need it.
