Now 17, consider and take appropriate action on the following requests regarding title 30.
a, discuss detention basin and water quality control inspection and maintenance amendments; and b, set a public hearing on December 15, 2009, to receive comments regarding amendments to the code.

>> good afternoon.
anna baldwin and tom webber, Travis County t.n.r.
the city of Austin initiated these two proposed code amendments.
section 30-4-153 delineates maintenance and inspection obligations for detention base since, and section 30-5-231 of title 30 delineates maintenance and inspection obligations for water quality facilities.
there is some common language or similar language in each code provision and while most of what is proposed are clarifications and codifications of existing or long-standing city practices, there are some new code provisions in each.
with regards to detention basins, they are clarifying if an owner of a development -- the owner of a commercial development is required to maintain the pond even if the pond is on another piece of property.
they are also clarifying that if one pond serves more than one property, the owner of record of the pond and the other properties, commercial properties it serves, are all responsible for the maintenance.
they are also putting it in writing that the city does not inspect detention basins that are integral parts of county roads.
that responsibility would be the county's.
it's a new provision in here that -- in this code that Austin will inspect the commercial detention basins at least once every three years to ensure that the basin is being maintained per standard, and the city will have the ability to charge a reinspection fee if the pond fails and if they have to go back out to reinspect it.
it's -- for residential detention basins, those are to be maintained by the homeowners association.
it's a new requirement in here -- or a new provision in here that before the pond -- the detention basin can be assigned to a homeowners association, executive manager would have to give approval of that.
and it also gives the executive manager authorization to use an alternative agreement to having the homeowners association maintain the pond.
that's basically what is being proposed for detention basins, which is title 30 -- section 30-4-153.
with regards to water quality, it's very similar -- the water quality -- commercial water quality pond would be maintained by the owner of the commercial development whether or not the pond is on that piece of property or not.
if one pond serves more than one commercial development, the owner of record of the commercial pond and the commercial properties being served are all responsible.
if the city accepts the water quality pond for maintenance because it meets environmental criteria manual, they would be inspecting it every -- I guess every three years.
and just as a reminder, code changes to title 30 have to be approved both by the city of Austin and Travis County.
so this has already been approved by the city of Austin and now they are coming to Travis County to try to get our approval so it can be added to title 30.

>> did they give the public an opportunity to provide input?

>> yes, sir.
and we are proposing to have a public hearing as well.
on December 15th.
but my understanding that they did, that it's already been approved through I guess planning and zoning commission, zoning and platting.
probably the environmental board and city council.
