>> we have returned from executive session where we discussed the following items.
number 30 involving the -- the transfer station operated by Texas disposal systems landfill, inc., on county owned property on 620 near state highway 71 west, is there a motion?

>> move that we counter with option 3.

>> second.

>> discussion?
all in favor?
that passes by unanimous vote.
number 31, the matter involving j adan ballesteros vs.
Travis County, we will have that back in the future.
the matter involving Travis County and the state of Texas, 32, against the coldwater development limited and rod man excavation, inc., the matter involving hamilton pool and hamilton creek, we got another briefing on that matter, we took action on another item today that involved money, source of funding, et cetera, to start.
the work out there.
number 24.
and anything in addition need to be taken under 32?

>> no.

>> I don't think so, judge.

>> okay.
we discussed very, very briefly 33, any action required?
that was the matter involving alicia perez.
34, the matter involving linda Moore smith we discussed very briefly, also.
any action?
motion?
35 is a matter involving potential acquisition of approximately 260.4 acres of land owned by new life international in conjunction with the the balcones canyonland preserves conservation plan.
legal prepared a counter offer set of terms and they provide for an action to be taken by December 31st.
and an initial deposit paid by the county with an eye to closing on this property, June 30th, 2010.
all of that is in that document prepared by legal.
move that we approve it.

>> second.

>> discussion?
will that cover it, mr.
hilly?

>>

>> [indiscernible]

>> whenever it's been fully finalized with the -- with the seller.

>> authorize our county judge to sign that document if the seller agrees.
any more discussion?
all in favor?
that passes by unanimous vote.
36 is a matter involving a potential purchase of real estate on airport boulevard.
move that we renew our offer to purchase this property for the sum of $750,000, but we add a lease back option for 18 months at the sum of $1,000 per month.

>> second.

>> do you consider it friendly assuming a close by the end of the year?

>> that's friendly to me.
i don't know whether it hurt or helps.
let's add it anyway.

>> okay.

>> is that supposed to be a carrot or a knife?

>> [laughter] we'll add it anyway.
we'll see.
any more discussion?
all in favor?
that passes by unanimous vote.
a 1 is a matter involving the lawsuit by heather johnson against Travis County and susan spitaro.
we did get a briefing.
any action required?
it will be back on when appropriate.
a 2 the matter involving the -- we took action on that item earlier, that's the golden gloves matter.
we did all we need to do on that, right?

>> we did, judge, this morning.

>> a 3 we just got a briefing on the notice of violation from tceq regarding the flea market land where the fire recently occurred.
and it's only posted -- well, it says take appropriate action.
but based on what we heard, no action required today.
this will be back on the agenda for recommended remedial action at some point soon, I believe.
a 4 the matter involving the automobiles, equipment for constable vehicles, composition of vehicle use committee, did we give tentative approval to the -- to the smaller committee?

>> yes.
i think we did.

>> no?

>> no?
okay.

>> really, I think we ought to vote with an eye toward giving final approval next Tuesday, unless we hear something significant to the contrary.
what our county judge recommended was instead of 25 or 30 members of this community we ended up with about 7.
but the various categories of users be represented.
leaving open the door to be persuaded that others should be added or some should be taken off, if that information can be provided to us by Friday of this week.
but our goal would be to take action on Tuesday, if we want to head in this direction.
so it's more direction than anything else, but I'm looking for a formal vote with an eye to taking a final formal vote next Tuesday and I move approval.

>> second.

>> of that particular thing.

>> discussion?
so this is downsizing the vehicle use committee and hopefully next week to have the charge for them.
this is just the committee size, okay?
discussion?
all in favor?
that passes by unanimous vote.
my second motion is that we draft an appropriate charge for distribution by Friday at 5:00 and if any member of the court has ideas or any user of vehicles at Travis County, if they will get those to the county judge's office, unless you want to be in charge, mr.
rhoades.

>> your call, judge.

>> okay.
get them to the county judge's office.
i'll use my bully pulpit, how is that?
we talked about funding, amount of funding, kinds of vehicles, cost savings, any other ideas that vehicle users have to give the Commissioners court, if they will get those to us by 5:00, we will put them in a draft charge for consideration by the court next Tuesday.
that's the motion.

>> second.

>> seconded by Commissioner Gomez, discussion?
all in favor?
that passes by unanimous vote.
we do need to do additional research on the other matter that we discussed regarding the relationship by the Commissioners court and the constables and vehicles and other resources that the court votes on.
we will only have three members in court next Tuesday, right?
or will we have four?
but -- four the week after?
mr.
rhoades?

>> action upon item 5 and item 6, judge.

>> all right.
one of those involves co's.

>> the reimbursement resolution, do we want the whole of -- hold off of that for a week.

>> I tell you what.
let's put five and six -- well, let's take off of 6 --

>> a 1.

>> the matter involving the vehicles.

>> okay.
okay, that will be a 1.

>> just vote t 1.

>> t 1 the transfer.

>> yeah, just do that.

>> okay.
move approval.

>> second.

>> discussion?
all in favor?
that passes by unanimous vote.
and on the rest of that, let's just bring it back next Tuesday, okay, so we can kind of mull over it just one more week.

>> yes, sir.

>> what I was about to say, the other part of the item that involves the court and constables, we probably need two weeks on that.
we'll have four members of the court in two weeks, right?
it would be -- it would be a lot better if we could have four of us here rather than three.
okay?
so with that, we are done for business today.

>> move adjourn.

>> all in favor?
that passes by unanimous vote.
5:56 p.m.
