>> good afternoon, let's call to order the Travis County housing finance corporation.
one item.
consider and take appropriate action on results of monitoring review by the Texas department of housing and community affairs.

>> good afternoon, I'm harvey Davis, manager of the corporation.
and we last discussed this -- the review on September 15th.
and since that time, the -- the Texas department of housing and community affairs extended the deadline to -- to resolve the issues until October 22nd.
two days from now.
and as you will recall, there were three projects that they -- that they were questioning, whether the home buyer was qualified or not.
one of those projects, the department, has okayed, so there's still two remaining projects that we're still working on.
one I gave you a legal opinion by -- that was prepared by cliff blunt that outlined why we feel like the home buyer qualified as a first-time home buyer.
that was sent to the department early this morning and then on the second issue, the home buyer has promised me he would send me his w-2 forms for 2008, which would pretty definitively tell whether that home buyer qualified or not.
i've not received that -- the w-2, I left him another message this morning.
but we were able to contact him after some difficulty and he promised he would send that.
so ...
we're still working on these two outstanding issues and -- and of course we have this -- this deadline that's two days away from -- from now.
and so what I'm asking the board is for you to authorize president Biscoe to -- to disperse, if necessary, up to $15,000 if we need to repay the department.

>> would a good strategy be to request an extension of the deadline?
still working on getting the information they requested?

>> I would be happy to do that.
i have not -- I have not asked for another extension.

>> in lieu of -- of approving

>> [indiscernible] judge.

>> I would approve the item, but as an alternative strategy, I would ask for an extension, tell them that we've clarified one of them, working on the other two.
with a little additional time we are hopeful of a positive result.
knowing our friends at the state, mr.
davis, they are more than reasonable, most of the time.

>> they are pretty reasonable, yeah, I will say that.
and if we do that, then it might be a good idea to -- to also have this on the agenda for next week, if necessary.

>> okay.
that's the motion to -- to pursue two strategies, two alternative strategies, one is to -- to authorize me to sign a $15,000 check, if necessary, but, two, first, to request an extension of the deadline and indicate to our state partners that we are still working on gathering the information they requested.

>> that's part of the original motion.

>> that's two of them.
sort of a and b.

>> second that one, too, then.

>> be real bold when you make that request, mr.
davis.
make sure they know you mean it.

>> okay.
