13 is to approve award for ifb number b-10000.
there's four -- 1 dr, residential roof repair, replacement services to the low bidder valdez remodeling and weatherization, inc.
and this will be under the consultation with attorney exception to the open meetings act.
we'll discuss these items in executive session but will return to open court before taking any action.

25 is the matter involving Travis County and others versus cold water development limited, rod man excavation, hamilton pool matter.
i -- we did get our briefing, we will have this matter back on the court's agenda next week, October 20th, 2009, with additional wording broken down into three or four parts.
that will allow us to take multiple items.
we will make that happen.
26 is the the potential lease of real estate in north Austin for the Travis County juvenile probation.
i move that we authorize county staff to proceed with the lease negotiation.

27 and 28 we did not discuss although we announced them, we probably need a full complement of court members and not much action since we last discussed this matter.
i move that we authorize the county judge and Commissioner Gomez to get with our lawyers and meet with legal counsel for both of these claimants to discuss this matter further.
with an eye to having it back on the court's agenda on October 20th, 2009.
for appropriate action.

i move that we authorize facilities staff to deal with health and human services to negotiate a possible lease of this real estate.

30 we discussed and got a briefing and instead of taking action today, I move that we mull over this possibility, have it back on the court's agenda next week for possible action.
that's October 20th.

>> 31 concerning the settlement offer regarding payment for star flight services rendered to lance bigheart.
i move that we accept the offer of $1,257.60, 1257.60 to settle this matter.

32 is the matter involving the lawsuit by george gikas against Travis County and others.
i move that we authorize the county attorney to file an appropriate cross claim in this matter to protect the interests of Travis County.

that's the -- the compensation lien on the claims by benjamin maldanado subrogation, I move that we accept the counter offer of $6,000 to be paid to Travis County by the insurance carrier.

but that's -- I think we ought to lay this out and kind of hear it and see if we're interested in doing it.
a 3 to consider and take appropriate application regarding application for american recovery and reinvestment act funds through the Texas state comptroller state energy conservation office competitive grant to use for the installation or distributable renewable energy power generation facilities at Travis County owned facilities located at the exposition center and at the san antonio parking garage.

>> judge, before you go there, on the other executive session item, 33, did we -- did we need to maybe address that?

>> the thing about that is that the -- that the -- there are a couple of other matters even before it gets back to the commission, for the commission action.

>> because they are saying that the new proposal from the administrative law judge will probably be January 7, 2007.
so the commission probably late January or February at the earliest, I would think.

that's the matter involving the application for expansion filed by the waste management of Texas landfill located at giles road.
Commissioner Davis?

>> yes, judge.
i would like to move that we direct the Travis County attorney's staff to continue to pursue an effort through the -- through the administrative law judge efforts, of course that process has not been exhausted, but we like to direct the county -- Travis County attorney's staff to report back to the Commissioners court as soon as this particular issue is -- is finalized, as the folks may recall, Travis County has gone on record as opposing this particular expansion by waste management of Texas.
and, of course, I think that we will be able to proceed accordingly after the exhaustion of this particular matter.
so I want to make sure that the county attorney's office is aware of what we're trying to seek here and we may have positioned ourself to take other actions after that particular last ruling, action by the administrative law judge has taken place.
so I want to make sure that's a part of the record so they will know that -- that there's other actions that we need to probably pursue after that.
