Item 12

Now, on number 12 to be honest I think the whole court needs to be here to discuss that one.
valdez remodeling and weatherization.

>> I agree.

>> john, anything that we need to discuss today?
we had an executive session discussion last time and basically the legal issues are still there, we probably need a follow-up executive session --

>> I can advise you on what the contract says and whether there needs to be any changes to that contract.
i can do that very quickly in executive session.

>> do we have another week?

>> this current contract expires tomorrow.
but --

>> is that one of those automatic extensions until --

>> no.
there's no more extensions.
we haven't spent that much in the last 12 months, so we probably would be okay for a while without a contract.
but I just wanted to let you all know that it does expire tomorrow.

>> okay.
do we have a contract -- contracts being worked on today that would stop if we don't take action?

>> I can't speak specifically to that.
it would -- we would -- I think we would be able to finish anything that's underway, but we wouldn't be able to assign any new work to this contractor until this issue was resolved.

>> we issued p.o.'s as late as September the 9th.
whether those jobs are done or not, I don't know.

>> my best guess would be they are in varying stages of completion.

>> legally, is there a way for us to get those projects completed even if the current contract expires.

>> based on the fact that there was a contract whenever those jobs were started, they should be paid.
i don't think the auditor will give you any trouble in getting those jobs paid.

>> yeah, I just think that this is important enough to have a full court present.
it's a county policy shift in addition to being -- to being -- sort of unique set of facts that we heard about last week.

>> yeah.

>> so -- judge, the only thing that I would add is that -- is that I guess the -- the biggest issue would be that if there are projects that would require expertise such as this company provides, we may have to shift our production schedule to accommodate, you know, getting a new contract entered.
so if there's something in the queue that we would have normally referred, we might have to -- to push that date in favor of a project that -- that might not require roofing services.
so we essential can handle that -- we certainly can handle that, that would be the byproduct of not approving a contract for another week.

>> okay, if we have a contract in place on working done today, that contract secures take work through the end of -- of -- of -- to project completion.

>> this new contract would be for jobs going forward in October.
what you are -- the jobs that were in the queue already should be handled by the contract that expires tomorrow.

>> right.

>> same for those in the queue already under a purchase order?

>> right.
they will be paid.

>> work performed, compensation made.
okay.
let's make sure we land on it next week then.
i mean, I think the issues are out there.
there are several options, each has consequences, I just think that we need to discuss them as a -- as a full court.
more full than three.
to act on it.
okay?

>> yes, sir.

>> so with that on number 12, we will have it next week and indicate our intention to take action one way or the other.
next is 10-13.
okay.
