Travis County Commissioners Court

Item 43

View captioned video.

Now let's call 43, and next we'll call 44.
43, consider and take appropriate action regarding Travis County's economic development program policy including the following: a, adopt resolution indicating Travis County's election to become eligible to participate in tax abatement and to adopt guidelines and criteria for tax abatements.
b, adopt Travis County economic development program policy guidelines and christ for tax repatriot and tax abatement and other incentives.
and c, order amending chapter 28 of the Travis County coat: Travis County economic development program policy guidelines and criteria.

>> I'm not sure who would like to lay this out?

>> you do a great job.
i'm going to just applaud you.

>> I'm not sure quite how to do that.
43-a is simply a resolution indicating our -- you know, our desire to be eligible to participate in tax abatements.
and the intention to adopt guidelines and criteria under the statute.
aim correct about that, marietta?

>>

>> [inaudible].

>> so y'all want to take that one first?

>> sure.

>> move approval of a.

>> second.

>> okay, a would be what guidelines?

>> well, a is under the statute it requires that the court pass a resolution indicating its intent to participate in tax abatement and to adopt guidelines.
so that's your first step is to approve this order.

>> a is intent basically.

>> yes.
and the resolution got right here.

>> and I second it.

>> that's seconded.
any discussion?
that's the order containing the resolution?

>> containing the resolution.

>> discussion?
all in favor?
that passes by unanimous vote.

>> 43-b is in regard to actually adopting policy guidelines and criteria for the tax rebate or tax abatement or other incentives.
and the question before us is whether or not to -- to reauthorize our old policy in anticipation of revisiting a draft policy prior to December 31st of this year.

>> okay, and is that the date in the --

>> ending date.

>> is that the date set forth in b?
december 31st, 2009?

>> I know I plugged the date in a couple of places.

>> okay.

>> the date is in the order.
that will be your next thing.
that's not in the policy the policy has the statutory language for the two years, and it can be amended or deleted by a vote, super majority vote of the court.
so that's what's in your poll simple then your order that's c, subsection c today, has the December 31st date.

>> so what is b then?

>> b is your actual guidelines.
these are the old guidelines.

>> those are the old -- those are the verbatim guidelines that we had before.

>> yes.
i just changed the effective date.

>> okay.
discussion?
move approval.

>> second.

>> discussion?
all in favor?
that passes by unanimous vote.
and c.

>> c is just a mop-up to amend chapter 28 to approve what we just voted.

>> it has the deadline.

>> yes.
the order, it's in your backup.
the reason you don't have an order to sign is that the order includes this resolution and a copy of the guidelines and criteria.
so as soon as I get the signed resolution, I can put together your number c for you to sign that order.
but it has to include the others so I have to wait until I get that back.
but the order does have the December 31st deadline in it.

>> okay.
the order must be in my original documents.

>> yes.

>> folder.

>> section 6.
says Travis County intends to guidelines adopted under this order to direct the county economic development program from the date of adoption through a date no later than December 31, 2009, at which time the court will adopt other guidelines and criteria to replace these guidelines.
it's a one-page order.

>> so is that order hand delivered to my office or --

>> it was e-mailed.

>> okay.
it's safely secured on my computer, then.
the court has to sign it, right?
the whole court?

>> yes, but I'll have to attach the resolution and the guidelines before you can sign it.
there are attachments to this so that's why I have to get you the first one I gave you, then I'll bring you it back.
this is yours to have it if you want it so you'll know what --

>> okay.
so I don't have to give this back to you.

>> no.
i'll print another one.

>> now --

>> move approval of the order.

>> second.

>> discussion?
all in favor?
that passes by unanimous vote.
so we have done what's necessary to put our own order back in place and we're -- what's left is to complete the new one between now and the end of this year.

>> yes.

>> calendar year.

>> judge, it can probably be completed much more swiftly than that and we will await the flood gate of proposals

>> [indiscernible].

>> okay.

>> sounds great.

>> anything else on this item?
okay.
thank you very much.
