25 is is to consider and take appropriate action related to modification number 2, contract number ps 090100 re with american youth works for marks services as follows.
a, ratify work done prior to execution of the agreement.
b, amend the contract to add the ranger station project and the nature trail at milton reimers ranch park project, and c, amend the contract to clarify the workforce training nature of the agreement.

marvin bryce, assistant purchasing agent.
just got in the nick of time.
this original contract, judge, is for improvements at our parks and trails and park reserves.
original contract modification number 2 when it came to ours office was for the renovation of a range of station.
excuse me--ranger station.
upon reviewing that we questioned whether that particular scope of that work should be considered a public works or construction project.
we on ferd with county--conferred with county attorney's office as well as tnr and it was determined that it could be handled under the guys of training which is what this contract initially is for.
for training under american youth works.
what we also found out, unfortunately, is that while we were in discussions with the attorneys and tnr, american youth works were actually doing this work.
so it had been done prior to approval of the modification.
so what we are doing now are a few things as described in the agenda.
we are bringing the mod back now to ratify the work that has already been performed, to incorporate the ranger station, and then to clarify for future needs in case we want to do future projects to be determined or may be determined to be construction or professional services, to clarify that it is in fact training services under the contract.

the only question we had was that some of this work is bond funded for the fund verification.
what we asked was that the training cannot be paid from bond funds, only the construction and materials.
they agreed that they will provide that to us so that we can verify funding from the appropriate source with the contract.

that can be done after today?
>> yes.
>> move approval.
>> second.
