Let's call item -- a quick update since we do have the right parties here, a-3.
after a-3 we will go back to 38, hrmd.
a-3 is to consider and take appropriate action regarding final payment retainage to unism development company, inc., a subcontractor of faulkner u.s.a.
for work performed on the Travis County correctional complex, additions.
this matter surfaced for us last week.
and basically the court's position was that if the subcontractor were not paid by today, then the court would take this matter up to try to figure out what the situation is and how we can resolve it.
since last week we only had one side present in court.
and mr.
bryce, we have had some movement on this since last week?

>> yes, sir.

>> okay.

>> morning, judge, Commissioners.
marvin bryce, assistant purchasing agent.
mr.
ken gatey with facilities management, who is the project manager, met with faulkner u.s.a.
and unism corporation.
both representatives are here.
i'm pleased to announce after several meetings that we have reached an agreement whereby faulkner u.s.a.
has billed for ret tainage, has killed Travis County for the retainage.
mr.
gate i.y has approved it, I have approved it and it is in the auditor's office right now.
faulkner u.s.a.
has also agreed that upon verification from the county that that invoice has been approved, that they will be willing to pay faulkner u.s.a.
within seven days of said verification.
i told mr.
beatsman that I will get him an e-mail and I'm telling him in open court that it has been approved and is sitting in the auditor's office.
i'll follow that up within a e-mail, but he's willing to pay them in advance of receiving the actual payment from the county.
he's committed to seven days after receiving official notification from us.

>> okay.
after receiving official notification of?

>> that his invoice has been approve bid facilities management as well as my office and is in the auditor's office waiting for payment.
i can tell him that now he now itis sitting in the auditors process.
it will have to go through our normal process in the county, but he is willing to go ahead and pay faulkner in advance of receiving a check from Travis County.

>> when will he get his check in hand?
that's the bottom line.

>> seven days from today.

>> seven days from today he will get his money.

>> correct.

>> is that correct?

>> seven days from today, yes, sir.

>> all right.

>> that's September 1st or 2nd.

>> yes, sir.

>> we do have a faulkner representative here?

>> yes, sir.
he's here as well as a representative from unism that can verify our conversation if the court has questions.

>> I'm just wondering if there are any other outstanding situations such as unism?
are they all caught up with all of those -- is that the only -- in other words, is this going to come back again to the court?

>> no, sir.

>> all right.
this is the only one that's outstanding, is that correct?

>> I can't answer that.

>> why not?

>> I can't answer that, sir.
i can only speak to this situation because I've been personally involved in this situation.

>> okay.
i'm just wondering if there are any other outstanding situations other than this.

>> I haven't received any information or have been intimately involved in any other dealings with the subcontractors as I have in this one.
we typically don't get this involved in subcontractor relationships.

>> I understand.

>> okay.
so the representative from faulkner u.s.a.
is who?

>> chris letzma.

>> you've heard what the court has heard today?

>> yes, sir.

>> > is faulkner in agreement with that?

>> yes, sir.

>> so he can expect payment the first part of next week?

>> within seven days (indiscernible).

>> okay.
and that delivery will be made how?
by hand delivery or --

>> hand delivery.

>> he will be called to pick it up?

>> yes, sir.

>> okay.
any other questions from the court?
we appreciate y'all working together.

gatey, we didn't give you a chance to say anything.

>> I don't have anything to add.
the only thing I could add would be to try to address Commissioner Davis' question.
we are not aware of any other subcontractors that have a problem being paid.
normally what happens when-- if there are subs that are not being paid, often times we hear about it or sometimes they even walk off the job, and that hasn't been happening.
we haven't been hearing complaints, we haven't had people walking off the job.
they're getting real close to completion and everybody is there trying to get it completed right now.

>> move that we approve the arrangement that has been described today to get unism development paid.
