Executive Session

>> moving on -- actually, we can -- there are a couple of executive session items.
do we want to try to get as much done as we can?

>> 26 we're going to do this afternoon?

>> well, actually, I was thinking about executive session right now.
26 we really need, I think, to discuss part of this in executive session for legal advice on a couple of them.
26 is to consider and take appropriate action regarding setting elected officials' salaries for fiscal year 2010, including a, set salaries, b, longevity pay for judges qualifying under the eligibility prescribed in senate bill 497 and 26-c, whether to approve payment for duties as presiding criminal district court judge as allowed under house bill 3468.
and in executive session under consultation with attorney, the question really is that discretionnary versus shall and comparing those two is where I want a little legal advice on them.
and if we add to the added items, a-1, there's one executive session item.
3333, consider and take appropriate action regarding possible sale of county-owned land off fm 969 in east Austin.
consultation with attorney and real estate -- real property matters exception to the open meetings act.
a-1, receive briefing and take appropriate action on fire safety issues related to manchaca community center located at 1310 fm 1626.
the consultation with attorney exception.
a-2 a, receive legal briefing and take appropriate action and implore on Commissioners court authority to process -- and process to hear appeal of employee grievance against county elected officials.
that's under the consultation attorney with exception.
and I don't think that we need b in executive session.
that's simply to set the hearing based on the advice that we're given under a-2-a.
so we'll discuss these few items in executive session, but will return to open court before taking any action.

finishes number 26, on b and c further advice and mull our the requests further.
but we are ready to take action on 26-a today.

as I mentioned, 26-b and c will be back on the court's agenda next week for further review and deliberations.
33 is the matter involving the possible sale of county owned land --

>> that approval is approval of the order setting the salaries that you will all sign, which you don't have yet but I will get to you.

i'm sure our county clerk got it.
although our county judge did not.
233, possible sale of county owned land off fm 969 in east Austin.
move that we authorize the potential buyer of the land on the front part, that the county needs to see a list of possible uses for our approval or that we revisit this matter at the time when the potential buyer has a specific project in mind.

and do you want to put a time line when the purchaser is to produce this in writing?
how long are we talking about?
or is the motion indicating that --

>> well on, this part I think we'll leave it open ended like that so if we don't get it, there's no reason to put it back on the court's agenda.
i think we ought to do a second one pertaining to the city of Austin, right?

>> yeah.
yeah.

>> but on that motion, on the land on the front of -- front tract, I will call it.

on the other tract we have been negotiating with the city of Austin.
i do think that we have reached terms on that and we have the latest version of a contract of sale.
and so let's ask the city of Austin to sign that contract and have the Commissioners court approve it next week.

a 1 is the matter valving the manchaca community center.
appropriate county reps including the fire marshal will visit mr.
voegel at the center tomorrow afternoon as fire marshal's office and facilities and they will observe the situation and take whatever action is necessary.
especially in terms of compliance with the specific actions requested in in a 7-day period.

on a-2we we did get our briefing in a and on b which we did not discuss but I think is appropriate for us to set this hearing and follow action to a.
i move that we authorize the county judge to try to coordinate a hearing of this appeal on the afternoon of August 18th, which is two weeks from today, and if August 18th won't work, then August 25th, which is three weeks.
what we typically do is try to schedule it where we will have a couple hours available late Tuesday and those are Tuesdays two and three weeks from today.
and what we'll do is coordinate with your schedules and the appellee and appellate.
