5 to contract no.
05ae0140jj, halff associates, inc., for mckinney falls parkway project.

this is a modification number 5 to the -- to the a and e contract.
apparently there's some work that has to be done with the city of Austin to install a 40-inch water main into the design plan.
they say that the -- that the city has agreed to compensate the county for the work performed.

minella here to explain further.

>> I just need a clarification of all of these terms.
this is not to exceed contract.
and we keep making modifications to a not to exceed contract.
what does that mean?
>> well, we anticipate that the cost will be not to exceed amount of x.
hopefully we stay within that not to exceed amount.
however, if there's complications and there's always is with a and e work and construction then we come back to court and increase that amount not to exceed.
we actually pay for the work done.
it's not a fixed firm price.
we are going to save 50,000 regardless of what work you do.
it's laid out as you do these things, we will pay you for that work and hopefully it won't exceed -- I'm just using $50,000 as an example.
it's sort of a -- of a commitment that when you start having changes, then we have to come back and amend the contract.

and puts us in the position of the court deciding whether to go ahead and get additional work done rather than the contractor doing work with that, the court -- without the court being aware of what's happening.

the project copy is changing, so the not to exceed amount needs to change to meet the additional expense of the change and scope.
the majority of the changes for this particular project were triggered by request being the city of Austin -- requesting the city of Austin adding in --

if we did not accommodate them, then they would go out in front of us or we would go in front of them, stepping all over each other, perhaps damaging each other's work.
in this case we are going to do the work concurrently under a single contract managed by the county.
it's the most efficient way of getting it done.
>> they will pay for the additional services.

>> so our not to exceed covers certain services.
we are adding to those services so we need to add money to it.
>> that's correct.
>> the city is picking up the money that we're having to add to accommodate their requests.
>> through an approved interlocal approved several weeks ago.

it's clear to me now.
