Executive Session
We have come to executive session.
number 10 we discussed a little bit this morning, consider and take appropriate action on request to use parking lot and comfort facilities at palm school on July 4th, 2009 from 4:00 p.m.
to 8:00 p.m.
we'll take this into executive session.
32 is posted for executive session.
and that's to revise the language, receive briefing from county attorney and take appropriate action regarding claims by john strickland junior for damages at 12717 bullick hollow road, Austin, Texas, 78726, consultation with attorney exception to the open meetings act.
33, receive legal briefing from county attorney and take appropriate action regarding settlement offer in claim by lindaura dasilva concerning a tax resale deed.

34, receive legal briefing and take appropriate action regarding settlement offer in claim by drake communications inc.
concerning r.f.p.
number p 080107, consultation with attorney.
35, consider and take appropriate action on an offer to sell temporary easement rights to Travis County for use of land in the upcoming reconstruction of a county bridge located on fuchs grove road in precinct 1.
that's the real property exception to the open meetings act.
36, receive briefing and take appropriate action regarding issues related to novation of license agreement for operation of manchaca community center located at 1310 fm 1626.
consultation with attorney and real property exceptions to the open meetings act.
and number 37, our final item, receive legal briefing and take appropriate action on prevailing wage rate complaint received from subcontractor/employee performing work on additions and alterations to the Travis County correctional complex project.

we will discuss these items in executive session, but will return to open court before taking any action.

35 is a matter involving an offer to sell temporary easement rights to Travis County for a transportation project.
>> judge, I move that we accept the offer for $3,900 for the easement on the fuchs rural road.
and also that permanent and temporary fences will be placed in this area, but done by the owner.

vogel has signed already that we have this matter back on the court's agenda next week for further discussion.

item number 37 involves a claim by a subcontractor/employee performing work on this county project, and we were provided appropriate wording for a motion in this matter.
i move that we direct the Travis County purchasing office to work with the county attorney to draft a letter to faulkner u.s.a.
and its subcontractor, double h homes, requiring them, one, to make restitution to the double h homes workers who were not paid prevailing wages.
that this action be provided no later than August 1st of 2009.
and that the county be provided written verification that restitution has been made in full.
further, that this communication indicate that if the wages are not paid as required by law, then the county will consider seriously withholding the amount necessary to make the workers whole and/or impose an appropriate penalty as required by law immediately after August 1st.

>> the difference there is that rather than saying we'll do it, we'll have it back on the court's agenda for follow-up discussion.
